ਮੁੱਖ ਮੰਤਰੀ ਦੇ ਹੈਲੀਕਾਪਟਰ ਦੀ ਵਰਤੋਂ ਬਾਰੇ ਪੋਸਟ ਦਾ ਮਾਮਲਾ: ਹਾਈ ਕੋਰਟ ਵੱਲੋਂ ਜਾਂਚ 'ਤੇ ਰੋਕ
ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਮੁੱਖ ਮੰਤਰੀ ਦੇ ਹੈਲੀਕਾਪਟਰ ਦੀ ਵਰਤੋਂ ਸਬੰਧੀ ਸੋਸ਼ਲ ਮੀਡੀਆ 'ਤੇ ਪਾਈ ਗਈ ਇੱਕ ਪੋਸਟ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਦਰਜ ਐਫ.ਆਈ.ਆਰ. (FIR) ਦੀ ਜਾਂਚ 'ਤੇ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕਰਦਿਆਂ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਜਵਾਬ ਤਲਬ ਕੀਤਾ ਹੈ। ਇਹ ਫੈਸਲਾ ਪ੍ਰਗਟਾਵੇ ਦੀ ਆਜ਼ਾਦੀ ਅਤੇ ਕਾਨੂੰਨੀ ਪ੍ਰਕਿਰਿਆ ਦੇ ਸੰਤੁਲਨ ਨੂੰ ਦੇਖਦੇ ਹੋਏ ਲਿਆ ਗਿਆ ਹੈ
ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਮੁੱਖ ਮੰਤਰੀ ਭਗਵੰਤ ਮਾਨ ਦੇ ਹੈਲੀਕਾਪਟਰ ਦੀ ਵਰਤੋਂ ਬਾਰੇ ਸੋਸ਼ਲ ਮੀਡੀਆ ਪੋਸਟ ਨਾਲ ਸਬੰਧਤ ਇੱਕ ਅਪਰਾਧਿਕ ਮਾਮਲੇ ਵਿੱਚ ਅਹਿਮ ਫੈਸਲਾ ਸੁਣਾਇਆ ਹੈ। ਅਦਾਲਤ ਨੇ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਦਰਜ ਕੇਸ ਦੀ ਜਾਂਚ 'ਤੇ ਅਗਲੇ ਹੁਕਮਾਂ ਤੱਕ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਹੈ। ਇਹ ਮਾਮਲਾ ਉਦੋਂ ਸ਼ੁਰੂ ਹੋਇਆ ਸੀ ਜਦੋਂ ਇੱਕ ਵਿਅਕਤੀ ਵਿਰੁੱਧ ਹੈਲੀਕਾਪਟਰ ਦੀ ਵਰਤੋਂ ਨੂੰ ਲੈ ਕੇ ਟਿੱਪਣੀ ਕਰਨ ਦੇ ਦੋਸ਼ ਵਿੱਚ ਮਾਮਲਾ ਦਰਜ ਕੀਤਾ ਗਿਆ ਸੀ।
ਅਦਾਲਤ ਨੇ ਸੁਣਵਾਈ ਦੌਰਾਨ ਕਿਹਾ ਕਿ ਲੋਕਤੰਤਰ ਵਿੱਚ ਵਿਚਾਰਾਂ ਦੀ ਆਜ਼ਾਦੀ ਅਤੇ ਆਲੋਚਨਾ ਦੀ ਆਪਣੀ ਇੱਕ ਅਹਿਮ ਥਾਂ ਹੈ। ਇਸ ਫੈਸਲੇ ਨੇ ਪ੍ਰਗਟਾਵੇ ਦੀ ਆਜ਼ਾਦੀ ਅਤੇ ਨਾਗਰਿਕਾਂ ਦੇ ਅਧਿਕਾਰਾਂ ਵਿਚਕਾਰ ਇੱਕ ਮਜ਼ਬੂਤ 'ਭਾਵਨਾਤਮਕ ਸਾਂਝ' ਅਤੇ ਭਰੋਸਾ ਪੈਦਾ ਕੀਤਾ ਹੈ। ਹਾਈ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕਰਕੇ ਪੁੱਛਿਆ ਹੈ ਕਿ ਇਸ ਪੋਸਟ ਵਿੱਚ ਅਜਿਹਾ ਕੀ ਅਪਰਾਧਿਕ ਸੀ ਜਿਸ ਕਾਰਨ ਐਫ.ਆਈ.ਆਰ. ਦਰਜ ਕਰਨ ਦੀ ਲੋੜ ਪਈ।
ਇਹ ਮਾਮਲਾ ਸੋਸ਼ਲ ਮੀਡੀਆ ਦੀ ਵਰਤੋਂ ਅਤੇ ਉਸ 'ਤੇ ਕੀਤੀ ਜਾਣ ਵਾਲੀ ਬਹਿਸ ਦੀਆਂ ਹੱਦਾਂ ਨਾਲ ਵੀ ਡੂੰਘੀ ਸਾਂਝ ਰੱਖਦਾ ਹੈ। ਪਟੀਸ਼ਨਕਰਤਾ ਦੇ ਵਕੀਲਾਂ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਪੋਸਟ ਸਿਰਫ਼ ਜਾਣਕਾਰੀ ਅਤੇ ਨਿੱਜੀ ਰਾਏ 'ਤੇ ਅਧਾਰਿਤ ਸੀ। ਹਾਈ ਕੋਰਟ ਦੀ ਇਸ ਕਾਰਵਾਈ ਨਾਲ ਸਰਕਾਰੀ ਤੰਤਰ ਅਤੇ ਆਮ ਜਨਤਾ ਵਿਚਕਾਰ ਕਾਨੂੰਨੀ ਪਾਰਦਰਸ਼ਤਾ ਦੀ ਸਾਂਝ ਹੋਰ ਪੀਢੀ ਹੋਈ ਹੈ। ਹੁਣ ਸਭ ਦੀਆਂ ਨਜ਼ਰਾਂ ਸਰਕਾਰ ਵੱਲੋਂ ਦਿੱਤੇ ਜਾਣ ਵਾਲੇ ਜਵਾਬ ਅਤੇ ਅਗਲੀ ਸੁਣਵਾਈ 'ਤੇ ਟਿਕੀਆਂ ਹੋਈਆਂ ਹਨ।
