ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਪੱਤਰਕਾਰ ਰਾਮ ਚੰਦਰ ਛੱਤਰਪਤੀ ਕਤਲ ਕੇਸ ਵਿੱਚ ਡੇਰਾ ਮੁਖੀ ਰਾਮ ਰਹੀਮ ਨੂੰ ਬਰੀ ਕਰਨ ਦੇ ਵਿਸਥਾਰਪੂਰਵਕ ਕਾਰਨ ਦੱਸੇ ਹਨ। ਅਦਾਲਤ ਨੇ ਸੀਬੀਆਈ ਦੀ ਜਾਂਚ ਵਿੱਚ ਵੱਡੀਆਂ ਖਾਮੀਆਂ ਪਾਉਂਦਿਆਂ ਕਿਹਾ ਕਿ ਜਾਂਚ ਏਜੰਸੀ ਪੁਖ਼ਤਾ ਸਬੂਤ ਪੇਸ਼ ਕਰਨ ਵਿੱਚ ਨਾਕਾਮ ਰਹੀ ਹੈ।
ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਡੇਰਾ ਸੱਚਾ ਸੌਦਾ ਮੁਖੀ ਗੁਰਮੀਤ ਰਾਮ ਰਹੀਮ ਸਿੰਘ ਅਤੇ ਹੋਰਨਾਂ ਨੂੰ ਪੱਤਰਕਾਰ ਰਾਮ ਚੰਦਰ ਛੱਤਰਪਤੀ ਕਤਲ ਕੇਸ ਵਿੱਚ ਬਰੀ ਕਰਨ ਦੇ ਆਪਣੇ ਫੈਸਲੇ ਦੀਆਂ ਬਾਰੀਕੀਆਂ ਸਾਂਝੀਆਂ ਕੀਤੀਆਂ ਹਨ। ਅਦਾਲਤ ਨੇ ਆਪਣੇ 91 ਪੰਨਿਆਂ ਦੇ ਫੈਸਲੇ ਵਿੱਚ ਕੇਂਦਰੀ ਜਾਂਚ ਏਜੰਸੀ (CBI) ਦੀ ਕਾਰਜਪ੍ਰਣਾਲੀ 'ਤੇ ਸਖ਼ਤ ਟਿੱਪਣੀਆਂ ਕੀਤੀਆਂ ਹਨ। ਅਦਾਲਤ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਕਿਸੇ ਨੂੰ ਵੀ ਸਿਰਫ਼ ਸ਼ੱਕ ਦੇ ਆਧਾਰ 'ਤੇ ਦੋਸ਼ੀ ਨਹੀਂ ਠਹਿਰਾਇਆ ਜਾ ਸਕਦਾ ਅਤੇ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਸੀਬੀਆਈ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਸਬੂਤਾਂ ਵਿੱਚ ਕਈ ਕੜੀਆਂ ਗੁੰਮ ਸਨ।
ਅਦਾਲਤ ਨੇ ਮੁੱਖ ਗਵਾਹ ਖੱਟਾ ਸਿੰਘ ਦੀ ਗਵਾਹੀ 'ਤੇ ਸਵਾਲ ਚੁੱਕਦਿਆਂ ਕਿਹਾ ਕਿ ਉਸ ਦੇ ਬਿਆਨਾਂ ਵਿੱਚ ਇਕਸਾਰਤਾ ਦੀ ਕਮੀ ਸੀ। ਹਾਈ ਕੋਰਟ ਨੇ ਪਾਇਆ ਕਿ ਜਾਂਚ ਦੌਰਾਨ ਕਈ ਅਹਿਮ ਤੱਥਾਂ ਨੂੰ ਨਜ਼ਰਅੰਦਾਜ਼ ਕੀਤਾ ਗਿਆ ਅਤੇ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਸਬੂਤ ਡੇਰਾ ਮੁਖੀ ਨੂੰ ਕਤਲ ਦੀ ਸਾਜ਼ਿਸ਼ ਨਾਲ ਸਿੱਧੇ ਤੌਰ 'ਤੇ ਜੋੜਨ ਲਈ ਕਾਫ਼ੀ ਨਹੀਂ ਸਨ। ਅਦਾਲਤ ਅਨੁਸਾਰ, ਇਸ ਕੇਸ ਦੀ ਜਾਂਚ ਵਿੱਚ ਪਾਰਦਰਸ਼ਤਾ ਦੀ ਕਮੀ ਸੀ ਅਤੇ ਏਜੰਸੀ ਨੇ ਫੈਸਲੇ 'ਤੇ ਪਹੁੰਚਣ ਲਈ ਬਹੁਤ ਜ਼ਿਆਦਾ ਦੇਰੀ ਕੀਤੀ, ਜਿਸ ਕਾਰਨ ਕੇਸ ਦੀ ਮਜ਼ਬੂਤੀ ਪ੍ਰਭਾਵਿਤ ਹੋਈ।
ਹਾਈ ਕੋਰਟ ਨੇ ਆਪਣੇ ਫੈਸਲੇ ਵਿੱਚ ਇਹ ਵੀ ਕਿਹਾ ਕਿ ਹੇਠਲੀ ਅਦਾਲਤ ਨੇ ਸਬੂਤਾਂ ਦਾ ਸਹੀ ਮੁਲਾਂਕਣ ਨਹੀਂ ਕੀਤਾ ਸੀ। ਅਦਾਲਤ ਨੇ ਟਿੱਪਣੀ ਕੀਤੀ ਕਿ ਨਿਆਂਇਕ ਪ੍ਰਕਿਰਿਆ ਵਿੱਚ ਸਬੂਤਾਂ ਦੀ ਗੁਣਵੱਤਾ ਸਭ ਤੋਂ ਉੱਪਰ ਹੁੰਦੀ ਹੈ, ਜਿਸ ਵਿੱਚ ਸੀਬੀਆਈ ਪੂਰੀ ਤਰ੍ਹਾਂ ਨਾਕਾਮ ਰਹੀ। ਇਸ ਫੈਸਲੇ ਨੇ ਹੁਣ ਸੀਬੀਆਈ ਦੀਆਂ ਜਾਂਚ ਤਕਨੀਕਾਂ 'ਤੇ ਵੱਡੀ ਬਹਿਸ ਛੇੜ ਦਿੱਤੀ ਹੈ।
The Punjab and Haryana High Court has shared detailed insights into its decision to acquit Dera Sacha Sauda chief Gurmeet Ram Rahim Singh and others in the journalist Ram Chandra Chhatrapati murder case. In its 91-page judgment, the court made strong observations regarding the working of the Central Bureau of Investigation (CBI). The court clarified that no one can be convicted based on mere suspicion and that several links were missing in the evidence presented by the CBI in this case.
The court questioned the testimony of the key witness, Khatta Singh, noting a lack of consistency in his statements. The High Court found that several crucial facts were ignored during the investigation, and the evidence presented was insufficient to directly link the Dera chief to the murder conspiracy. According to the court, the investigation lacked transparency, and the agency took an inordinate amount of time to reach a conclusion, which weakened the strength of the case.
The High Court further noted in its verdict that the lower court had not accurately evaluated the evidence. The court remarked that in the judicial process, the quality of evidence is paramount, a standard in which the CBI failed significantly. This judgment has now sparked a major debate regarding the investigative techniques of the CBI.
