ਕਰਨਲ ਨਾਲ ਕੁੱਟਮਾਰ ਮਾਮਲਾ: ਸੁਪਰੀਮ ਕੋਰਟ ਸੋਮਵਾਰ ਨੂੰ ਸੁਣਵਾਈ ਕਰੇਗੀ
ਪਟਿਆਲਾ ਵਿੱਚ ਮਾਰਚ ਵਿੱਚ ਕਰਨਲ ਪੁਸ਼ਪਿੰਦਰ ਸਿੰਘ ਬਾਠ ਅਤੇ ਉਸ ਦੇ ਪੁੱਤਰ ਨਾਲ ਪੰਜਾਬ ਪੁਲਿਸ ਦੀ ਕਥਿਤ ਮਾਰਪੀਟ ਦੇ ਮਾਮਲੇ ਦੀ ਸੀਬੀਆਈ ਜਾਂਚ ਨੂੰ ਚੁਣੌਤੀ ਦੇਣ ਵਾਲੀ ਪਟੀਸ਼ਨ ’ਤੇ ਸੁਪਰੀਮ ਕੋਰਟ ਸੋਮਵਾਰ ਨੂੰ ਸੁਣਵਾਈ ਕਰੇਗੀ। ਕਰਨਲ ਬਾਠ ਨੇ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ 12 ਅਧਿਕਾਰੀਆਂ ’ਤੇ ਬਿਨਾਂ ਉਕਸਾਵੇ ਦੇ ਹਮਲਾ ਕਰਨ, ਪਛਾਣ ਪੱਤਰ ਅਤੇ ਮੋਬਾਈਲ ਖੋਹਣ ਦਾ ਦੋਸ਼ ਲਾਇਆ ਹੈ। ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ ਜਾਂਚ ਸੀਬੀਆਈ ਨੂੰ ਸੌਂਪੀ ਸੀ, ਕਿਉਂਕਿ ਚੰਡੀਗੜ੍ਹ ਪੁਲਿਸ ਨੇ ਨਿਰਪੱਖ ਜਾਂਚ ਨਹੀਂ ਕੀਤੀ।
ਕਰਨਲ ਪੁਸ਼ਪਿੰਦਰ ਸਿੰਘ ਬਾਠ ਅਤੇ ਉਸ ਦੇ ਪੁੱਤਰ ਅੰਗਦ ਨਾਲ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ 12 ਅਧਿਕਾਰੀਆਂ ਵੱਲੋਂ ਕਥਿਤ ਮਾਰਪੀਟ ਦੇ ਮਾਮਲੇ ਦੀ ਜਾਂਚ ਸੀਬੀਆਈ ਨੂੰ ਸੌਂਪਣ ਦੇ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਹੁਕਮ ਨੂੰ ਚੁਣੌਤੀ ਦੇਣ ਵਾਲੀ ਪਟੀਸ਼ਨ ’ਤੇ ਸੁਪਰੀਮ ਕੋਰਟ ਸੋਮਵਾਰ ਨੂੰ ਸੁਣਵਾਈ ਕਰੇਗੀ। ਇਹ ਘਟਨਾ 13 ਅਤੇ 14 ਮਾਰਚ ਦੀ ਰਾਤ ਨੂੰ ਪਟਿਆਲਾ ਦੇ ਰਾਜਿੰਦਰਾ ਹਸਪਤਾਲ ਨੇੜੇ ਇੱਕ ਢਾਬੇ ’ਤੇ ਵਾਪਰੀ ਸੀ, ਜਦੋਂ ਕਰਨਲ ਪੁਸ਼ਪਿੰਦਰ ਸਿੰਘ ਬਾਠ ਅਤੇ ਉਸ ਦੇ ਪੁੱਤਰ ਅੰਗਦ ਖਾਣਾ ਖਾ ਰਹੇ ਸਨ। ਕਰਨਲ ਬਾਠ ਨੇ ਦੋਸ਼ ਲਾਇਆ ਹੈ ਕਿ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ ਚਾਰ ਇੰਸਪੈਕਟਰ ਸਮੇਤ 12 ਅਧਿਕਾਰੀਆਂ ਨੇ ਬਿਨਾਂ ਕਿਸੇ ਉਕਸਾਵੇ ਦੇ ਉਸ ਅਤੇ ਉਸ ਦੇ ਪੁੱਤਰ ’ਤੇ ਹਮਲਾ ਕੀਤਾ, ਉਸ ਦਾ ਪਛਾਣ ਪੱਤਰ ਅਤੇ ਮੋਬਾਈਲ ਫੋਨ ਖੋਹ ਲਿਆ ਅਤੇ “ਫਰਜ਼ੀ ਐਨਕਾਊਂਟਰ” ਦੀ ਧਮਕੀ ਦਿੱਤੀ। ਇਹ ਸਾਰਾ ਵਾਕਿਆ ਸੀਸੀਟੀਵੀ ਕੈਮਰਿਆਂ ਦੀ ਨਿਗਰਾਨੀ ਹੇਠ ਅਤੇ ਲੋਕਾਂ ਦੀ ਮੌਜੂਦਗੀ ਵਿੱਚ ਵਾਪਰਿਆ।
ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਨੇ 16 ਜੁਲਾਈ ਨੂੰ ਇਸ ਮਾਮਲੇ ਦੀ ਜਾਂਚ ਸੀਬੀਆਈ ਨੂੰ ਸੌਂਪ ਦਿੱਤੀ ਸੀ, ਕਿਉਂਕਿ ਚੰਡੀਗੜ੍ਹ ਪੁਲਿਸ ਨੇ ਮਾਮਲੇ ਦੀ ਨਿਰਪੱਖ ਜਾਂਚ ਨਹੀਂ ਕੀਤੀ। 3 ਅਪ੍ਰੈਲ ਨੂੰ ਹਾਈਕੋਰਟ ਨੇ ਚੰਡੀਗੜ੍ਹ ਪੁਲਿਸ ਨੂੰ ਜਾਂਚ ਚਾਰ ਮਹੀਨਿਆਂ ਵਿੱਚ ਪੂਰੀ ਕਰਨ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਸਨ, ਪਰ ਕਰਨਲ ਬਾਠ ਦਾ ਆਰੋਪ ਸੀ ਕਿ ਚੰਡੀਗੜ੍ਹ ਪੁਲਿਸ ਨੇ “ਨਿਰਪੱਖ ਅਤੇ ਇਮਾਨਦਾਰ” ਜਾਂਚ ਨਹੀਂ ਕੀਤੀ। ਜਾਂਚ ਚੰਡੀਗੜ੍ਹ ਦੇ ਸੁਪਰਡੰਟ ਆਫ ਪੁਲਿਸ ਮਨਜੀਤ ਸ਼ੇਰੋਂ ਦੀ ਅਗਵਾਈ ਵਿੱਚ ਇੱਕ ਸਪੈਸ਼ਲ ਇਨਵੈਸਟੀਗੇਸ਼ਨ ਟੀਮ (ਐਸਆਈਟੀ) ਵੱਲੋਂ ਕੀਤੀ ਜਾ ਰਹੀ ਸੀ। ਪਟੀਸ਼ਨ ਵਿੱਚ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਕਿ ਜਾਂਚ ਏਜੰਸੀ ਵੱਲੋਂ ਕੋਈ ਵੀ ਗੈਰ-ਜ਼ਮਾਨਤੀ ਵਾਰੰਟ, ਪ੍ਰੋਕਲੇਮਡ ਅਫੈਂਡਰ (ਪੀਓ) ਕਾਰਵਾਈ ਜਾਂ ਕੋਈ ਹੋਰ ਕਾਨੂੰਨੀ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਨਹੀਂ ਕੀਤੀ ਗਈ, ਜੋ ਇਮਾਨਦਾਰੀ ਨਾਲ ਜਾਂਚ ਦੇ ਯਤਨਾਂ ਨੂੰ ਦਰਸਾਉਂਦੀ ਹੋਵੇ।
ਕਰਨਲ ਬਾਠ ਨੇ ਪੰਜਾਬ ਪੁਲਿਸ ’ਤੇ ਆਰੋਪ ਲਾਇਆ ਕਿ ਮੁਲਜ਼ਮ ਅਧਿਕਾਰੀਆਂ ਨੇ ਉਸ ਦੀ ਬਾਂਹ ਤੋੜ ਦਿੱਤੀ ਅਤੇ ਉਸ ਦੇ ਪੁੱਤਰ ਦੇ ਸਿਰ ’ਤੇ ਸੱਟ ਮਾਰੀ। ਉਸ ਨੇ ਦੱਸਿਆ ਕਿ ਪੰਜਾਬ ਪੁਲਿਸ ਅਧੀਨ ਨਿਰਪੱਖ ਜਾਂਚ ਸੰਭਵ ਨਹੀਂ ਸੀ, ਇਸ ਲਈ ਉਸ ਨੇ ਸੀਬੀਆਈ ਜਾਂ ਕਿਸੇ ਹੋਰ ਸੁਤੰਤਰ ਏਜੰਸੀ ਕੋਲ ਜਾਂਚ ਤਬਦੀਲ ਕਰਨ ਦੀ ਮੰਗ ਕੀਤੀ। ਸਾਰੇ 12 ਮੁਲਜ਼ਮ ਪੁਲਿਸ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਮੁਅੱਤਲ ਕਰ ਦਿੱਤਾ ਗਿਆ ਹੈ ਅਤੇ ਉਨ੍ਹਾਂ ਵਿਰੁੱਧ ਵਿਭਾਗੀ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕੀਤੀ ਗਈ ਹੈ। ਸੁਪਰੀਮ ਕੋਰਟ ਦੀ ਸੁਣਵਾਈ ਜਸਟਿਸ ਸੰਜੈ ਕੁਮਾਰ ਅਤੇ ਜਸਟਿਸ ਸਤੀਸ਼ ਚੰਦਰ ਸ਼ਰਮਾ ਦੀ ਬੈਂਚ ਕਰੇਗੀ।
ਕਰਨਲ ਬਾਠ ਦੀ ਪਤਨੀ ਜਸਵਿੰਦਰ ਕੌਰ ਨੇ ਪੰਜਾਬ ਦੇ ਮੁੱਖ ਮੰਤਰੀ ਭਗਵੰਤ ਮਾਨ ਨਾਲ ਮੁਲਾਕਾਤ ਕਰਕੇ ਨਿਆਂ ਦੀ ਮੰਗ ਕੀਤੀ। ਮੁੱਖ ਮੰਤਰੀ ਨੇ ਉਨ੍ਹਾਂ ਨੂੰ ਭਰੋਸਾ ਦਿੱਤਾ ਸੀ ਕਿ ਨਿਆਂ ਮਿਲੇਗਾ, ਪਰ ਜਸਵਿੰਦਰ ਕੌਰ ਨੇ ਕਿਹਾ ਕਿ ਪੁਲਿਸ ਅਤੇ ਸਰਕਾਰ ਨੇ ਸਹੀ ਕਾਰਵਾਈ ਨਹੀਂ ਕੀਤੀ। ਉਨ੍ਹਾਂ ਨੇ ਦੋਸ਼ ਲਾਇਆ ਕਿ ਸ਼ੁਰੂ ਵਿੱਚ ਪੁਲਿਸ ਨੇ ਐਫਆਈਆਰ ਦਰਜ ਕਰਨ ਵਿੱਚ ਦੇਰੀ ਕੀਤੀ ਅਤੇ ਢਾਬੇ ਦੇ ਮਾਲਕ ਦੀ ਸ਼ਿਕਾਇਤ ’ਤੇ “ਅਫਰੇ” ਦਾ ਗਲਤ ਮਾਮਲਾ ਦਰਜ ਕੀਤਾ। ਸੈਨਾ ਨੇ ਵੀ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਨਿਰਪੱਖ ਅਤੇ ਸਮੇਂ ਸੀਮਾ ਵਿੱਚ ਜਾਂਚ ਦੀ ਮੰਗ ਕੀਤੀ ਹੈ, ਜਿਸ ਨੂੰ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ ਡੀਜੀਪੀ ਗੌਰਵ ਯਾਦਵ ਨੇ ਸਮਰਥਨ ਦਿੱਤਾ ਹੈ।
The Supreme Court will hear a petition on Monday challenging the Punjab and Haryana High Court’s order to transfer the investigation of the alleged assault on Colonel Pushpinder Singh Bath and his son Angad to the CBI, stemming from a parking dispute in Patiala in March. The incident occurred on the night of March 13-14 at a dhaba near Rajindra Hospital in Patiala while Colonel Pushpinder Singh Bath and his son were eating. Colonel Bath has accused 12 Punjab Police personnel, including four inspectors, of attacking him and his son without provocation, snatching his identity card and mobile phone, and threatening a “fake encounter,” all in public view and under CCTV footage.
On July 16, the Punjab and Haryana High Court transferred the case to the CBI because the Chandigarh Police failed to conduct an impartial investigation. On April 3, the High Court had ordered the Chandigarh Police to complete the investigation within four months, but Colonel Bath alleged that the Chandigarh Police did not conduct a “fair and honest” investigation. The investigation was led by a Special Investigation Team (SIT) under Chandigarh Superintendent of Police Manjeet Sheoran. The petition argued that the investigating agency did not issue any non-bailable warrants, proclaimed offender proceedings, or other legal actions that would indicate a sincere effort.
Colonel Bath alleged that the Punjab Police personnel fractured his arm and injured his son’s head. He stated that a fair investigation was impossible under the Punjab Police, prompting his demand for the case to be transferred to the CBI or another independent agency. All 12 accused police personnel have been suspended, and departmental proceedings have been initiated against them. The Supreme Court hearing will be conducted by a bench of Justice Sanjay Kumar and Justice Satish Chandra Sharma.
Colonel Bath’s wife, Jasvinder Kaur, met Punjab Chief Minister Bhagwant Mann to demand justice. The Chief Minister assured her that justice would be delivered, but Jasvinder Kaur claimed that neither the police nor the government took proper action. She alleged that the police initially delayed registering an FIR and filed a false “affray” case based on the dhaba owner’s complaint. The Army has also demanded a fair and time-bound investigation, supported by Punjab Police DGP Gaurav Yadav.
