ਦਿੱਲੀ ਦੰਗੇ ਮਾਮਲਾ: ਸੁਪਰੀਮ ਕੋਰਟ ਵੱਲੋਂ ਚਾਰ ਹੋਰ ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਜ਼ਮਾਨਤ, ਤੁਰੰਤ ਰਿਹਾਅ ਕਰਨ ਦੇ ਹੁਕਮ
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ 2020 ਦੇ ਦਿੱਲੀ ਦੰਗਿਆਂ ਨਾਲ ਸਬੰਧਤ ਇੱਕ ਮਾਮਲੇ ਵਿੱਚ ਵੱਡਾ ਫੈਸਲਾ ਸੁਣਾਉਂਦਿਆਂ ਚਾਰ ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਜ਼ਮਾਨਤ ਦੇ ਦਿੱਤੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਇਨ੍ਹਾਂ ਚਾਰਾਂ ਨੂੰ ਤੁਰੰਤ ਜੇਲ੍ਹ ਤੋਂ ਰਿਹਾਅ ਕਰਨ ਦੇ ਹੁਕਮ ਜਾਰੀ ਕੀਤੇ ਹਨ। ਇਹ ਫੈਸਲਾ ਅਦਾਲਤ ਵੱਲੋਂ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਵਿੱਚ ਹੋ ਰਹੀ ਦੇਰੀ ਅਤੇ ਮੁਲਜ਼ਮਾਂ ਦੇ ਹੱਕਾਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦਿਆਂ ਲਿਆ ਗਿਆ ਹੈ
ਸਾਲ 2020 ਵਿੱਚ ਰਾਜਧਾਨੀ ਦਿੱਲੀ ਵਿੱਚ ਹੋਈ ਹਿੰਸਾ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇੱਕ ਅਹਿਮ ਸੁਣਵਾਈ ਦੌਰਾਨ ਚਾਰ ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਜ਼ਮਾਨਤ 'ਤੇ ਰਿਹਾਅ ਕਰਨ ਦਾ ਹੁਕਮ ਦਿੱਤਾ ਹੈ। ਅਦਾਲਤ ਨੇ ਮਾਮਲੇ ਦੀ ਗੰਭੀਰਤਾ ਨਾਲ ਜਾਂਚ ਕਰਨ ਤੋਂ ਬਾਅਦ ਇਹ ਪਾਇਆ ਕਿ ਇਹ ਚਾਰੋਂ ਮੁਲਜ਼ਮ ਲੰਬੇ ਸਮੇਂ ਤੋਂ ਹਿਰਾਸਤ ਵਿੱਚ ਸਨ। ਇਸ ਫੈਸਲੇ ਨਾਲ ਜਿੱਥੇ ਪੀੜਤ ਪਰਿਵਾਰਾਂ ਦੀਆਂ ਉਮੀਦਾਂ ਮੁੜ ਸੁਰਜੀਤ ਹੋਈਆਂ ਹਨ, ਉੱਥੇ ਹੀ ਕਾਨੂੰਨੀ ਪ੍ਰਕਿਰਿਆ ਦੀ ਨਿਰਪੱਖਤਾ ਵੀ ਸਾਹਮਣੇ ਆਈ ਹੈ।
ਅਦਾਲਤ ਨੇ ਆਪਣੇ ਫੈਸਲੇ ਵਿੱਚ ਕਿਹਾ ਕਿ ਮੁਕੱਦਮੇ ਦੀ ਸੁਣਵਾਈ ਵਿੱਚ ਹੋ ਰਹੀ ਦੇਰੀ ਕਾਰਨ ਕਿਸੇ ਨੂੰ ਅਣਮਿੱਥੇ ਸਮੇਂ ਲਈ ਜੇਲ੍ਹ ਵਿੱਚ ਨਹੀਂ ਰੱਖਿਆ ਜਾ ਸਕਦਾ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਟ੍ਰਾਇਲ ਕੋਰਟ ਨੂੰ ਹਦਾਇਤ ਕੀਤੀ ਹੈ ਕਿ ਉਹ ਇਨ੍ਹਾਂ ਚਾਰਾਂ ਦੀ ਰਿਹਾਈ ਲਈ ਲੋੜੀਂਦੀਆਂ ਰਸਮੀ ਕਾਰਵਾਈਆਂ ਨੂੰ ਜਲਦੀ ਮੁਕੰਮਲ ਕਰੇ। ਇਹ ਮੁਲਜ਼ਮ ਪਿਛਲੇ ਕਈ ਸਾਲਾਂ ਤੋਂ ਜੇਲ੍ਹ ਦੀਆਂ ਸਲਾਖਾਂ ਪਿੱਛੇ ਸਨ ਅਤੇ ਵਾਰ-ਵਾਰ ਜ਼ਮਾਨਤ ਦੀ ਅਪੀਲ ਕਰ ਰਹੇ ਸਨ।
ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਇਹ ਕਦਮ ਮਨੁੱਖੀ ਅਧਿਕਾਰਾਂ ਅਤੇ ਨਿਆਂ ਪ੍ਰਣਾਲੀ ਦੇ ਵਿਚਕਾਰ ਇੱਕ ਮਜ਼ਬੂਤ ਸਾਂਝ ਨੂੰ ਦਰਸਾਉਂਦਾ ਹੈ। ਅਦਾਲਤ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਜ਼ਮਾਨਤ ਦੇਣਾ ਇੱਕ ਨਿਯਮ ਹੈ ਅਤੇ ਜੇਲ੍ਹ ਇੱਕ ਅਪਵਾਦ, ਖਾਸ ਕਰਕੇ ਜਦੋਂ ਸੁਣਵਾਈ ਪੂਰੀ ਹੋਣ ਵਿੱਚ ਲੰਬਾ ਸਮਾਂ ਲੱਗਣ ਦੀ ਸੰਭਾਵਨਾ ਹੋਵੇ। ਇਸ ਫੈਸਲੇ ਤੋਂ ਬਾਅਦ ਹੁਣ ਇਨ੍ਹਾਂ ਚਾਰਾਂ ਵਿਅਕਤੀਆਂ ਦੇ ਘਰਾਂ ਵਿੱਚ ਖੁਸ਼ੀ ਦਾ ਮਾਹੌਲ ਹੈ, ਕਿਉਂਕਿ ਉਹ ਲੰਬੇ ਸਮੇਂ ਬਾਅਦ ਆਪਣੇ ਪਰਿਵਾਰਕ ਮੈਂਬਰਾਂ ਨਾਲ ਭਾਵਨਾਤਮਕ ਸਾਂਝ ਮੁੜ ਕਾਇਮ ਕਰ ਸਕਣਗੇ।
