ਰੇਪ ਕੇਸ ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਵੱਡਾ ਹੁਕਮ: ‘ਸਿਟ’ (SIT) ਸਾਦੇ ਕੱਪੜਿਆਂ ਵਿੱਚ ਜਾਵੇ ਪੀੜਤਾ ਦੇ ਘਰ
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇੱਕ ਜਬਰ-ਜਨਾਹ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਕਰਦਿਆਂ ਪੀੜਤਾ ਦੀ ਨਿੱਜਤਾ ਅਤੇ ਮਾਨਸਿਕ ਸਥਿਤੀ ਨੂੰ ਮੁੱਖ ਰੱਖਦਿਆਂ ਅਹਿਮ ਦਿਸ਼ਾ-ਨਿਰਦੇਸ਼ ਜਾਰੀ ਕੀਤੇ ਹਨ। ਅਦਾਲਤ ਨੇ ਹੁਕਮ ਦਿੱਤਾ ਹੈ ਕਿ ਵਿਸ਼ੇਸ਼ ਜਾਂਚ ਟੀਮ (SIT) ਦੇ ਮੈਂਬਰ ਪੀੜਤਾ ਦੇ ਘਰ ਜਾਂਚ ਲਈ ਜਾਣ ਵੇਲੇ ਪੁਲਿਸ ਵਰਦੀ ਦੀ ਬਜਾਏ ਸਾਦੇ ਕੱਪੜਿਆਂ ਵਿੱਚ ਜਾਣ। ਅਦਾਲਤ ਅਨੁਸਾਰ, ਅਜਿਹਾ ਕਰਨ ਨਾਲ ਪੀੜਤਾ ਅਤੇ ਉਸ ਦੇ ਪਰਿਵਾਰ ਨੂੰ ਸਮਾਜਿਕ ਨਾਮੋਸ਼ੀ ਅਤੇ ਵਾਧੂ ਮਾਨਸਿਕ ਦਬਾਅ ਤੋਂ ਬਚਾਇਆ ਜਾ ਸਕੇਗਾ।
ਭਾਰਤ ਦੀ ਸਰਵਉੱਚ ਅਦਾਲਤ ਨੇ ਸੰਵੇਦਨਸ਼ੀਲ ਅਪਰਾਧਾਂ, ਖਾਸ ਕਰਕੇ ਜਬਰ-ਜਨਾਹ ਦੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਜਾਂਚ ਦੇ ਤਰੀਕਿਆਂ ਨੂੰ ਲੈ ਕੇ ਇੱਕ ਮਿਸਾਲੀ ਫੈਸਲਾ ਸੁਣਾਇਆ ਹੈ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇੱਕ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਜਾਂਚ ਏਜੰਸੀਆਂ ਨੂੰ ਪੀੜਤਾ ਦੀ ਮਾਨਸਿਕ ਸਿਹਤ ਅਤੇ ਸਮਾਜਿਕ ਸਨਮਾਨ ਦਾ ਪੂਰਾ ਖਿਆਲ ਰੱਖਣਾ ਚਾਹੀਦਾ ਹੈ। ਅਦਾਲਤ ਨੇ ਹਦਾਇਤ ਕੀਤੀ ਹੈ ਕਿ ਮਾਮਲੇ ਦੀ ਜਾਂਚ ਕਰ ਰਹੀ ਐਸ.ਆਈ.ਟੀ. (SIT) ਜਦੋਂ ਵੀ ਪੀੜਤਾ ਦੇ ਨਿਵਾਸ ਅਸਥਾਨ 'ਤੇ ਜਾਵੇ, ਤਾਂ ਅਧਿਕਾਰੀ ਪੁਲਿਸ ਵਰਦੀ ਵਿੱਚ ਨਾ ਹੋਣ।
ਅਦਾਲਤ ਨੇ ਕਿਹਾ ਕਿ ਅਕਸਰ ਦੇਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਪੁਲਿਸ ਦੀਆਂ ਗੱਡੀਆਂ ਅਤੇ ਵਰਦੀਧਾਰੀ ਮੁਲਾਜ਼ਮਾਂ ਦੇ ਘਰ ਆਉਣ ਨਾਲ ਆਸ-ਪਾਸ ਦੇ ਲੋਕਾਂ ਵਿੱਚ ਕਈ ਤਰ੍ਹਾਂ ਦੀਆਂ ਚਰਚਾਵਾਂ ਸ਼ੁਰੂ ਹੋ ਜਾਂਦੀਆਂ ਹਨ, ਜੋ ਪੀੜਤਾ ਲਈ ਕਿਸੇ ਦੂਜੇ ਸਦਮੇ ਤੋਂ ਘੱਟ ਨਹੀਂ ਹੁੰਦੀਆਂ। ਸਾਦੇ ਕੱਪੜਿਆਂ ਵਿੱਚ ਜਾਣ ਨਾਲ ਜਾਂਚ ਦੀ ਗੁਪਤਤਾ ਬਣੀ ਰਹੇਗੀ ਅਤੇ ਪੀੜਤਾ ਬਿਨਾਂ ਕਿਸੇ ਡਰ ਜਾਂ ਦਬਾਅ ਦੇ ਆਪਣੇ ਬਿਆਨ ਦਰਜ ਕਰਵਾ ਸਕੇਗੀ।
ਇਸ ਤੋਂ ਇਲਾਵਾ, ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇਹ ਵੀ ਯਕੀਨੀ ਬਣਾਉਣ ਲਈ ਕਿਹਾ ਹੈ ਕਿ ਜਾਂਚ ਟੀਮ ਵਿੱਚ ਮਹਿਲਾ ਅਧਿਕਾਰੀ ਲਾਜ਼ਮੀ ਤੌਰ 'ਤੇ ਸ਼ਾਮਲ ਹੋਣ। ਅਦਾਲਤ ਦਾ ਮੰਨਣਾ ਹੈ ਕਿ ਅਜਿਹੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਪੀੜਤ ਧਿਰ ਨੂੰ ਸੁਰੱਖਿਅਤ ਮਾਹੌਲ ਦੇਣਾ ਸਰਕਾਰ ਅਤੇ ਪੁਲਿਸ ਦੀ ਮੁਢਲੀ ਜ਼ਿੰਮੇਵਾਰੀ ਹੈ।
India's Supreme Court has delivered a landmark judgment regarding the methods of investigation in sensitive crimes, particularly rape cases. During the hearing of a case, the court clarified that investigative agencies must pay full attention to the mental health and social dignity of the victim. The court instructed that whenever the SIT (Special Investigation Team) investigating the case visits the victim's residence, the officers should not be in police uniform.
The court observed that the arrival of police vehicles and uniformed personnel often triggers gossip and discussions among neighbors, which can be as traumatic as a second shock for the victim. Visiting in plain clothes will maintain the confidentiality of the investigation and allow the victim to record her statement without fear or pressure.
Furthermore, the Supreme Court emphasized ensuring that female officers are mandatorily included in the investigation team. The court believes that providing a safe environment for the victim is the primary responsibility of the government and the police.
