ਪੰਜਾਬ ਦੀ ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ ਹਾਈ ਕੋਰਟ ’ਚ ਚੁਣੌਤੀ ਦਾ ਸਾਹਮਣਾ

ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਇੱਕ ਜਨਹਿਤ ਪਟੀਸ਼ਨ ਰਾਹੀਂ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ‘ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ’ ਨੂੰ ਚੁਣੌਤੀ ਦਿੱਤੀ ਗਈ ਹੈ। ਪੰਜਾਬ ਸਰਕਾਰ ਵੱਲੋਂ ਨੋਟੀਫਾਈਡ ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ ਦੇ ਖਿਲਾਫ ਵਿਰੋਧੀ ਧਿਰਾਂ ਅਤੇ ਕਿਸਾਨ ਜਥੇਬੰਦੀਆਂ ਪਹਿਲਾਂ ਹੀ ਸੰਘਰਸ਼ ਕਰ ਰਹੀਆਂ ਹਨ। ਹੁਣ ਇਸ ਨੀਤੀ ਵਿਰੁੱਧ ਕਾਨੂੰਨੀ ਲੜਾਈ ਵੀ ਸ਼ੁਰੂ ਹੋ ਗਈ ਹੈ। ਸਮਾਜਿਕ ਕਾਰਕੁਨ ਨਵਿੰਦਰ ਪੀਕੇ ਸਿੰਘ ਅਤੇ ਸਮਿਤਾ ਕੌਰ ਨੇ ਜਨਹਿਤ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਕੇ ਇਸ ਨੀਤੀ ਨੂੰ ਚੁਣੌਤੀ ਦਿੱਤੀ ਹੈ।

ਹਾਈ ਕੋਰਟ ਦੇ ਮੁੱਖ ਜਸਟਿਸ ਸ਼ੀਲ ਨਾਗੂ ਦੀ ਅਗਵਾਈ ਵਾਲੇ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਨੇ ਅੱਜ ਇਸ ਪਟੀਸ਼ਨ ਦੀ ਸੁਣਵਾਈ ਕੀਤੀ। ਬੈਂਚ ਨੇ ਪਟੀਸ਼ਨਰ ਨੂੰ ਪਟੀਸ਼ਨ ਵਿੱਚ ਕੁਝ ਸੋਧਾਂ ਕਰਨ ਲਈ ਕਿਹਾ ਹੈ। ਅਗਲੀ ਸੁਣਵਾਈ 19 ਅਗਸਤ ਨੂੰ ਹੋਵੇਗੀ। ਪਟੀਸ਼ਨ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ 4 ਜੁਲਾਈ ਨੂੰ ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ ਨੋਟੀਫਾਈ ਕਰਕੇ ਉਪਜਾਊ ਅਤੇ ਬਹੁ-ਫਸਲੀ ਜ਼ਮੀਨਾਂ ਨੂੰ ਐਕੁਆਇਰ ਕਰਨ ਦੀ ਯੋਜਨਾ ਬਣਾਈ ਹੈ।

ਪਟੀਸ਼ਨ ਵਿੱਚ ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ ਨੂੰ ਰੱਦ ਕਰਨ ਦੀ ਮੰਗ ਕੀਤੀ ਗਈ ਹੈ। ਪਟੀਸ਼ਨਰਾਂ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਹੈ ਕਿ ਇਹ ਨੀਤੀ ਨਿਰਪੱਖ ਮੁਆਵਜ਼ੇ, ਪ੍ਰਭਾਵਿਤ ਪਰਿਵਾਰਾਂ ਦੇ ਮੁੜ ਵਸੇਬੇ ਅਤੇ ਸਮਾਜਿਕ ਪ੍ਰਭਾਵਾਂ ਦੀ ਅਣਦੇਖੀ ਕਰਦੀ ਹੈ। ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਇਸ ਨੀਤੀ ਰਾਹੀਂ ਲਗਭਗ 65 ਹਜ਼ਾਰ ਏਕੜ ਜ਼ਮੀਨ ਐਕੁਆਇਰ ਕਰਨ ਦੀ ਯੋਜਨਾ ਬਣਾਈ ਹੈ, ਜਿਸ ਵਿੱਚ ਲੁਧਿਆਣਾ ਦੇ 50 ਪਿੰਡਾਂ ਦੀ 24 ਹਜ਼ਾਰ ਏਕੜ ਤੋਂ ਵੱਧ ਖੇਤੀ ਜ਼ਮੀਨ ਸ਼ਾਮਲ ਹੈ। ਸਰਕਾਰ ਸ਼ਹਿਰੀ ਵਿਕਾਸ ਅਤੇ ਉਦਯੋਗਿਕ ਵਿਕਾਸ ਦਾ ਹਵਾਲਾ ਦੇ ਰਹੀ ਹੈ।

ਪਟੀਸ਼ਨਰਾਂ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਇਸ ਨੀਤੀ ਕਾਰਨ ਹਜ਼ਾਰਾਂ ਕਿਸਾਨ ਪਰਿਵਾਰਾਂ ਦੀ ਰੋਜ਼ੀ-ਰੋਟੀ ’ਤੇ ਅਸਰ ਪਵੇਗਾ। ਪੰਜਾਬ ਦੀ ਉਪਜਾਊ ਖੇਤੀ ਜ਼ਮੀਨ ਵੀ ਖੁੱਸ ਜਾਵੇਗੀ। ਪਟੀਸ਼ਨਰਾਂ ਅਨੁਸਾਰ, ਇਹ ਨੀਤੀ ਭੂਮੀ ਪ੍ਰਾਪਤੀ, ਪੁਨਰਵਾਸ ਐਕਟ, 2013 ਦੀ ਮੂਲ ਭਾਵਨਾ ਦੇ ਖਿਲਾਫ ਹੈ। ਉਨ੍ਹਾਂ ਨੇ ਕਿਹਾ ਕਿ ਹਜ਼ਾਰਾਂ ਏਕੜ ਉਪਜਾਊ ਜ਼ਮੀਨ ਦੇ ਖੁੱਸਣ ਨਾਲ ਨਾ ਸਿਰਫ ਕਿਸਾਨ, ਸਗੋਂ ਜ਼ਮੀਨ ’ਤੇ ਨਿਰਭਰ ਹੋਰ ਤਬਕਿਆਂ ਦਾ ਰੁਜ਼ਗਾਰ ਵੀ ਪ੍ਰਭਾਵਿਤ ਹੋਵੇਗਾ, ਪਰ ਨੀਤੀ ਇਸ ਦੀ ਸੁਰੱਖਿਆ ਬਾਰੇ ਖਾਮੋਸ਼ ਹੈ। ਪਟੀਸ਼ਨ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਕਿਸਾਨਾਂ ਅਤੇ ਕਿਸਾਨ ਜਥੇਬੰਦੀਆਂ ਦੇ ਵਿਰੋਧ ਦੇ ਬਾਵਜੂਦ ਪੰਜਾਬ ਸਰਕਾਰ ਇਸ ਨੀਤੀ ਦੇ ਫਾਇਦੇ ਦੱਸ ਕੇ ਅੱਗੇ ਵਧ ਰਹੀ ਹੈ।

ਐੱਸਕੇਐੱਮ ਵੱਲੋਂ ਪੰਜਾਬ ’ਚ ਟਰੈਕਟਰ ਮਾਰਚ ਅੱਜ
ਚੰਡੀਗੜ੍ਹ: ਸੰਯੁਕਤ ਕਿਸਾਨ ਮੋਰਚਾ (ਐੱਸਕੇਐੱਮ) ਦੀ ਅਗਵਾਈ ਵਿੱਚ 30 ਜੁਲਾਈ ਨੂੰ ਪੰਜਾਬ ਭਰ ਵਿੱਚ ਟਰੈਕਟਰ ਮਾਰਚ ਕੀਤਾ ਜਾਵੇਗਾ। ਇਸ ਦੀ ਤਿਆਰੀ ਪੂਰੀ ਹੋ ਚੁੱਕੀ ਹੈ। ਇਹ ਲੈਂਡ ਪੂਲਿੰਗ ਨੀਤੀ ਵਿਰੁੱਧ ਪਹਿਲਾ ਵੱਡਾ ਅੰਦੋਲਨ ਹੋਵੇਗਾ, ਜਿਸ ਵਿੱਚ 116 ਪ੍ਰਭਾਵਿਤ ਪਿੰਡਾਂ ’ਤੇ ਫੋਕਸ ਕੀਤਾ ਜਾਵੇਗਾ। ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਟਰੈਕਟਰ ਮਾਰਚ ਨੂੰ ਰੋਕਣ ਲਈ ਪੁਲੀਸ ਨੂੰ ਮੁਸਤੈਦ ਕਰ ਦਿੱਤਾ ਹੈ। ਬੀਕੇਯੂ ਉਗਰਾਹਾਂ ਨੇ ਮਾਲਵਾ ਖਿੱਤੇ ਵਿੱਚ ਟਰੈਕਟਰ ਮਾਰਚ ਦੀ ਯੋਜਨਾ ਬਣਾਈ ਹੈ ਅਤੇ ਕਿਸਾਨ ਮਜ਼ਦੂਰ ਸੰਘਰਸ਼ ਕਮੇਟੀ ਨੇ ਵੀ ਇਸ ਨੂੰ ਹਮਾਇਤ ਦਿੱਤੀ ਹੈ। ਐੱਸਕੇਐੱਮ ਦੇ ਆਗੂ ਹਰਿੰਦਰ ਸਿੰਘ ਲੱਖੋਵਾਲ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਕੂਮ ਕਲਾਂ ਦੀ ਦਾਣਾ ਮੰਡੀ ਤੋਂ ਟਰੈਕਟਰ ਮਾਰਚ ਸ਼ੁਰੂ ਕਰਨਗੇ, ਜੋ ਪਿੰਡਾਂ ਵਿੱਚੋਂ ਹੁੰਦਾ ਹੋਇਆ ਰਤਨਗੜ੍ਹ ਵਿਖੇ ਸਮਾਪਤ ਹੋਵੇਗা। ਹਰ ਜ਼ਿਲ੍ਹੇ ਵਿੱਚ ਕਿਸਾਨ ਆਗੂਆਂ ਨੇ ਰੂਟ ਤੈਅ ਕੀਤੇ ਹਨ ਅਤੇ ਪ੍ਰਭਾਵਿਤ ਪਿੰਡਾਂ ਵਿੱਚੋਂ ਮਾਰਚ ਲੰਘੇਗਾ।

The Punjab and Haryana High Court has received a public interest petition challenging the Punjab Government’s Land Pooling Policy. Opposition parties and farmer organizations have already been protesting against the notified Land Pooling Policy, and now a legal battle has begun. Social activists Navinder PK Singh and Smita Kaur filed the public interest petition to challenge the policy.

A division bench led by Chief Justice Sheel Nagu heard the petition today. The bench asked the petitioners to make some amendments to the petition. The next hearing is scheduled for August 19. The petition states that the Punjab Government notified the Land Pooling Policy on July 4 to acquire fertile and multi-crop agricultural land.

The petitioners have demanded the cancellation of the Land Pooling Policy, arguing that it ignores fair compensation, rehabilitation of affected families, and the social impacts of the policy. The Punjab Government plans to acquire approximately 65,000 acres of land under the policy, including over 24,000 acres of agricultural land from nearly 50 villages in Ludhiana. The government cites urban development and industrial development as the reasons for land acquisition.

The petitioners argue that the Land Pooling Policy will affect the livelihoods of thousands of farmer families. It will also lead to the loss of thousands of acres of fertile agricultural land. According to the petitioners, the policy violates the core principles of the Bhumi Prapti, Punarvas Act, 2013. They claim that the loss of fertile land will not only impact farmers but also the livelihoods of other communities dependent on agriculture, yet the policy remains silent on their protection. The petition notes that despite opposition from farmers and farmer organizations, the Punjab Government is pushing the policy by highlighting its benefits.

SKM to Hold Tractor March Across Punjab Today
Chandigarh: Under the leadership of Sanyukt Kisan Morcha (SKM), a tractor march will be held across Punjab on July 30. Preparations for the march are complete. This will be the first major protest against the Land Pooling Policy, focusing on 116 affected villages. The Punjab Government has alerted the police to manage the tractor march. BKU Ugrahan has planned the tractor march in the Malwa region, and the Kisan Mazdoor Sangharsh Committee has announced its support. SKM leader Harinder Singh Lakhowal said the tractor march will start from Koom Kalan’s Dana Mandi, pass through villages, and conclude at Ratangarh. Farmer leaders have finalized routes in every district, and the march will pass through affected villages.
