ਲਾਹੌਰ ਹਾਈ ਕੋਰਟ ਵੱਲੋਂ ਸਿੱਖ ਸ਼ਰਧਾਲੂ ਸਰਬਜੀਤ ਕੌਰ ਮਾਮਲੇ 'ਤੇ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ, ਵੀਜ਼ਾ ਉਲੰਘਣਾ ਦੇ ਦੋਸ਼
ਭਾਰਤ ਤੋਂ ਸਿੱਖ ਸ਼ਰਧਾਲੂ ਵਜੋਂ ਪਾਕਿਸਤਾਨ ਗਈ ਸਰਬਜੀਤ ਕੌਰ ਖਿਲਾਫ ਲਾਹੌਰ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਗਈ ਹੈ। ਪਟੀਸ਼ਨ ਵਿੱਚ ਉਨ੍ਹਾਂ 'ਤੇ ਧਾਰਮਿਕ ਵੀਜ਼ਾ ਨਿਯਮਾਂ ਦੀ ਉਲੰਘਣਾ ਕਰਨ ਅਤੇ ਵੀਜ਼ਾ ਖਤਮ ਹੋਣ ਤੋਂ ਬਾਅਦ ਵੀ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਗੈਰ-ਕਾਨੂੰਨੀ ਤੌਰ 'ਤੇ ਰਹਿਣ ਦਾ ਦੋਸ਼ ਲਗਾਇਆ ਗਿਆ ਹੈ। ਸਾਬਕਾ ਵਿਧਾਇਕ ਮਹਿੰਦਰ ਪਾਲ ਸਿੰਘ ਦੀ ਇਸ ਪਟੀਸ਼ਨ 'ਤੇ ਹਾਈ ਕੋਰਟ ਨੇ ਪਾਕਿਸਤਾਨ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕਰਕੇ ਦੋ ਹਫ਼ਤਿਆਂ ਵਿੱਚ ਜਵਾਬ ਮੰਗਿਆ ਹੈ।
ਭਾਰਤ ਤੋਂ ਧਾਰਮਿਕ ਯਾਤਰਾ 'ਤੇ ਪਾਕਿਸਤਾਨ ਗਈ ਸਿੱਖ ਸ਼ਰਧਾਲੂ ਬੀਬੀ ਸਰਬਜੀਤ ਕੌਰ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਇੱਕ ਨਵਾਂ ਮੋੜ ਆਇਆ ਹੈ। ਉਨ੍ਹਾਂ ਖਿਲਾਫ ਲਾਹੌਰ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਇੱਕ ਨਵੀਂ ਸੰਵਿਧਾਨਕ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਗਈ ਹੈ, ਜਿਸ ਵਿੱਚ ਵੀਜ਼ਾ ਉਲੰਘਣਾ ਦੇ ਗੰਭੀਰ ਦੋਸ਼ ਲਗਾਏ ਗਏ ਹਨ। ਸ਼ੁੱਕਰਵਾਰ ਨੂੰ ਇਸ ਮਾਮਲੇ ਦੀ ਸ਼ੁਰੂਆਤੀ ਸੁਣਵਾਈ ਤੋਂ ਬਾਅਦ ਜਸਟਿਸ ਫਾਰੂਕ ਹੈਦਰ ਦੇ ਬੈਂਚ ਨੇ ਪਾਕਿਸਤਾਨ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕਰਕੇ ਦੋ ਹਫ਼ਤਿਆਂ ਦੇ ਅੰਦਰ ਜਵਾਬ ਮੰਗਿਆ ਹੈ।
ਇਹ ਪਟੀਸ਼ਨ ਪਾਕਿਸਤਾਨੀ ਪੰਜਾਬ ਅਸੈਂਬਲੀ ਦੇ ਸਾਬਕਾ ਮੈਂਬਰ ਅਤੇ ਮਨੁੱਖੀ ਅਧਿਕਾਰਾਂ ਲਈ ਸਾਬਕਾ ਸੰਸਦੀ ਸਕੱਤਰ ਮਹਿੰਦਰ ਪਾਲ ਸਿੰਘ ਨੇ ਆਪਣੇ ਵਕੀਲ ਰਾਹੀਂ ਦਾਇਰ ਕੀਤੀ ਹੈ। ਪਟੀਸ਼ਨ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਸਰਬਜੀਤ ਕੌਰ ਨੂੰ ਗੁਰੂ ਨਾਨਕ ਦੇਵ ਜੀ ਦੇ ਪ੍ਰਕਾਸ਼ ਪੁਰਬ ਮੌਕੇ 10 ਦਿਨਾਂ ਦਾ ਸਿੰਗਲ-ਐਂਟਰੀ ਧਾਰਮਿਕ ਵੀਜ਼ਾਜਾਰੀ ਕੀਤਾ ਗਿਆ ਸੀ, ਜੋ ਕਿ 13 ਨਵੰਬਰ 2025 ਤੱਕ ਹੀ ਵੈਧ ਸੀ। ਇਸ ਵੀਜ਼ੇ ਤਹਿਤ ਉਹ ਸਿਰਫ਼ ਨਨਕਾਣਾ ਸਾਹਿਬ ਅਤੇ ਕਰਤਾਰਪੁਰ ਵਰਗੇ ਮਨਜ਼ੂਰਸ਼ੁਦਾ ਧਾਰਮਿਕ ਸਥਾਨਾਂ ਤੱਕ ਹੀ ਸੀਮਤ ਰਹਿ ਸਕਦੀ ਸੀ।
ਪਟੀਸ਼ਨਰ ਦਾ ਦੋਸ਼ ਹੈ ਕਿ ਸਰਬਜੀਤ ਕੌਰ ਨੇ ਵੀਜ਼ੇ ਦੀਆਂ ਸ਼ਰਤਾਂ ਦੀ ਪਾਲਣਾ ਨਹੀਂ ਕੀਤੀ, ਨਿਰਧਾਰਤ ਸੀਮਾਵਾਂ ਤੋਂ ਬਾਹਰ ਯਾਤਰਾ ਕੀਤੀ, ਅਤੇ ਵੀਜ਼ਾ ਖਤਮ ਹੋਣ ਦੇ ਬਾਵਜੂਦ ਵੀ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਰਹਿਣਾ ਜਾਰੀ ਰੱਖਿਆ। ਇਹ ਸਪੱਸ਼ਟ ਤੌਰ 'ਤੇ ਵੀਜ਼ਾ ਉਲੰਘਣਾ ਅਤੇ ਗੈਰ-ਕਾਨੂੰਨੀ ਠਹਿਰਨ (overstay) ਦੇ ਤਹਿਤ ਆਉਂਦਾ ਹੈ। ਜ਼ਿਕਰਯੋਗ ਹੈ ਕਿ ਸਰਬਜੀਤ ਕੌਰ ਨੇ ਪਾਕਿਸਤਾਨ ਪਹੁੰਚਣ ਤੋਂ ਬਾਅਦ ਧਰਮ ਪਰਿਵਰਤਨ ਕਰਕੇ ਸਥਾਨਕ ਨੌਜਵਾਨ ਨਾਸਿਰ ਹੁਸੈਨ ਨਾਲ ਵਿਆਹ ਕਰਵਾ ਲਿਆ ਸੀ ਅਤੇ ਆਪਣਾ ਨਾਮ ਨੂਰ ਰੱਖ ਲਿਆ ਸੀ।
ਮਹਿੰਦਰ ਪਾਲ ਸਿੰਘ ਨੇ ਅਦਾਲਤ ਨੂੰ ਬੇਨਤੀ ਕੀਤੀ ਹੈ ਕਿ ਸਰਬਜੀਤ ਕੌਰ ਨੂੰ ਗੈਰ-ਕਾਨੂੰਨੀ ਢੰਗ ਨਾਲ ਰਹਿ ਰਹੀ ਵਿਦੇਸ਼ੀ ਘੋਸ਼ਿਤ ਕੀਤਾ ਜਾਵੇ ਅਤੇ ਉਨ੍ਹਾਂ ਦੀ ਤੁਰੰਤ ਗ੍ਰਿਫਤਾਰੀ ਅਤੇ ਦੇਸ਼ ਨਿਕਾਲਾ (Deportation) ਦਾ ਹੁਕਮ ਦਿੱਤਾ ਜਾਵੇ। ਇਸ ਤੋਂ ਇਲਾਵਾ, ਉਨ੍ਹਾਂ ਨੇ ਵੀਜ਼ਾ ਜਾਰੀ ਕਰਨ ਦੀ ਪ੍ਰਕਿਰਿਆ ਦੀ ਜਾਂਚ ਕਰਨ ਅਤੇ ਭਵਿੱਖ ਵਿੱਚ ਧਾਰਮਿਕ ਵੀਜ਼ਾ ਨੀਤੀ ਨੂੰ ਹੋਰ ਸਖ਼ਤ ਬਣਾਉਣ ਦੀ ਮੰਗ ਵੀ ਕੀਤੀ ਹੈ।
A new twist has emerged in the case of Sikh Pilgrim Sarabjit Kaur, an Indian citizen who traveled to Pakistan on a religious journey. A fresh constitutional petition has been filed against her in the Lahore High Court (LHC), leveling serious accusations of Visa Violation. Following the initial hearing on Friday, a bench led by Justice Farooq Haider issued a notice to the Pakistani government and demanded a response within two weeks.
This petition has been filed by Mahendra Pal Singh, a former member of the Punjab Assembly of Pakistan and former Parliamentary Secretary for Human Rights, through his lawyer. The petition claims that Sarabjit Kaur was issued a 10-day single-entry Religious Visa to attend the celebrations of Guru Nanak Dev Ji's Birth Anniversary, which was only valid until November 13, 2025. Her travel was strictly limited to approved religious sites like Nankana Sahib and Kartarpur.
The petitioner alleges that Sarabjit Kaur failed to comply with the visa conditions, traveled beyond the designated limits, and continued to stay in Pakistan even after her Visa had expired. This clearly falls under the category of Visa Violationand illegal overstay. It is noteworthy that Sarabjit Kaur converted to Islam after arriving in Pakistan, married a local man named Nasir Hussain, and changed her name to Noor.
Mahendra Pal Singh requested the court to declare Sarabjit Kaur an illegally staying foreigner and order her immediate arrest and Deportation to India. Furthermore, he also demanded an investigation into the visa issuance process and the need to make the Religious Visa policy more stringent in the future.
