ਹਿਰਾਸਤੀ ਤਸ਼ੱਦਦ ਮਾਮਲੇ ਵਿੱਚ ਇਤਿਹਾਸਕ ਫੈਸਲਾ: ਅਦਾਲਤ ਨੇ 9 ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਸੁਣਾਈ ਫਾਂਸੀ ਦੀ ਸਜ਼ਾ
ਭਾਰਤੀ ਨਿਆਂਪਾਲਿਕਾ ਨੇ ਹਿਰਾਸਤੀ ਤਸ਼ੱਦਦ (Custodial Torture) ਦੇ ਇੱਕ ਬੇਹੱਦ ਗੰਭੀਰ ਮਾਮਲੇ ਵਿੱਚ ਇਤਿਹਾਸਕ ਫੈਸਲਾ ਸੁਣਾਉਂਦਿਆਂ 9 ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਮੌਤ ਦੀ ਸਜ਼ਾ ਦਿੱਤੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਇਸ ਘਟਨਾ ਨੂੰ 'ਬੇਹੱਦ ਘਿਨਾਉਣਾ' ਅਤੇ ਮਨੁੱਖੀ ਅਧਿਕਾਰਾਂ ਦੀ ਸ਼ਰੇਆਮ ਉਲੰਘਣਾ ਕਰਾਰ ਦਿੱਤਾ ਹੈ। ਇਹ ਫੈਸਲਾ ਪੁਲਿਸ ਪ੍ਰਸ਼ਾਸਨ ਵਿੱਚ ਜਵਾਬਦੇਹੀ ਤੈਅ ਕਰਨ ਅਤੇ ਕਾਨੂੰਨ ਦੇ ਰਾਜ ਨੂੰ ਮਜ਼ਬੂਤ ਕਰਨ ਦੀ ਦਿਸ਼ਾ ਵਿੱਚ ਇੱਕ ਵੱਡਾ ਕਦਮ ਮੰਨਿਆ ਜਾ ਰਿਹਾ ਹੈ।
ਭਾਰਤ ਦੀ ਇੱਕ ਵਿਸ਼ੇਸ਼ ਅਦਾਲਤ ਨੇ ਹਿਰਾਸਤੀ ਮੌਤ ਅਤੇ ਤਸ਼ੱਦਦ ਦੇ ਇੱਕ ਪੁਰਾਣੇ ਪਰ ਬੇਹੱਦ ਸੰਵੇਦਨਸ਼ੀਲ ਮਾਮਲੇ ਵਿੱਚ ਅੱਜ ਉਹ ਫੈਸਲਾ ਸੁਣਾਇਆ ਹੈ, ਜਿਸ ਨੇ ਪੂਰੇ ਦੇਸ਼ ਦੇ ਪੁਲਿਸ ਵਿਭਾਗ ਵਿੱਚ ਹਲਚਲ ਮਚਾ ਦਿੱਤੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਦੋਸ਼ੀ ਪਾਏ ਗਏ 9 ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਫਾਂਸੀ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਹੈ। ਇਹ ਮਾਮਲਾ ਪੁਲਿਸ ਹਿਰਾਸਤ ਦੌਰਾਨ ਇੱਕ ਵਿਅਕਤੀ 'ਤੇ ਕੀਤੇ ਗਏ ਅਣਮਨੁੱਖੀ ਤਸ਼ੱਦਦ ਨਾਲ ਜੁੜਿਆ ਹੋਇਆ ਸੀ, ਜਿਸ ਕਾਰਨ ਉਸ ਦੀ ਮੌਤ ਹੋ ਗਈ ਸੀ।
ਅਦਾਲਤ ਨੇ ਆਪਣੇ ਫੈਸਲੇ ਵਿੱਚ ਸਖ਼ਤ ਟਿੱਪਣੀ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਜਿਨ੍ਹਾਂ ਮੋਢਿਆਂ 'ਤੇ ਕਾਨੂੰਨ ਦੀ ਰਾਖੀ ਦੀ ਜ਼ਿੰਮੇਵਾਰੀ ਸੀ, ਉਨ੍ਹਾਂ ਨੇ ਹੀ ਕਾਨੂੰਨ ਦੀਆਂ ਧੱਜੀਆਂ ਉਡਾਈਆਂ ਹਨ। ਜੱਜ ਨੇ ਕਿਹਾ ਕਿ ਹਿਰਾਸਤੀ ਹਿੰਸਾ ਲੋਕਤੰਤਰ 'ਤੇ ਇੱਕ ਕਲੰਕ ਹੈ ਅਤੇ ਅਜਿਹੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਨਰਮੀ ਨਹੀਂ ਵਰਤੀ ਜਾ ਸਕਦੀ। ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਵੱਲੋਂ ਆਪਣੀ ਤਾਕਤ ਦਾ ਗਲਤ ਇਸਤੇਮਾਲ ਕਰਕੇ ਇੱਕ ਨਿਰਦੋਸ਼ ਦੀ ਜਾਨ ਲੈਣਾ 'ਰੇਅਰੈਸਟ ਆਫ ਰੇਅਰ' (Rarest of Rare) ਸ਼੍ਰੇਣੀ ਵਿੱਚ ਆਉਂਦਾ ਹੈ।
ਬਚਾਅ ਪੱਖ ਦੇ ਵਕੀਲਾਂ ਨੇ ਸਜ਼ਾ ਘਟਾਉਣ ਲਈ ਕਈ ਦਲੀਲਾਂ ਦਿੱਤੀਆਂ, ਪਰ ਅਦਾਲਤ ਨੇ ਸਬੂਤਾਂ ਅਤੇ ਗਵਾਹਾਂ ਦੇ ਆਧਾਰ 'ਤੇ ਇਸ ਨੂੰ ਮਨੁੱਖਤਾ ਵਿਰੁੱਧ ਅਪਰਾਧ ਮੰਨਿਆ। ਇਸ ਫੈਸਲੇ ਤੋਂ ਬਾਅਦ ਪੀੜਤ ਪਰਿਵਾਰ ਨੇ ਰਾਹਤ ਦਾ ਸਾਹ ਲਿਆ ਹੈ, ਜੋ ਪਿਛਲੇ ਕਈ ਸਾਲਾਂ ਤੋਂ ਇਨਸਾਫ਼ ਲਈ ਕਾਨੂੰਨੀ ਲੜਾਈ ਲੜ ਰਿਹਾ ਸੀ।
