ਕਾਂਗਰਸ ਅਤੇ AIMIM ਆਗੂ ਵਕ਼ਫ਼ ਸੋਧ ਬਿੱਲ 2025 ਦੀ ਸੰਵਿਧਾਨਕਤਾ 'ਤੇ ਸੁਪਰੀਮ ਕੋਰਟ ਗਏ
ਕਾਂਗਰਸ ਸੰਸਦ ਮੈਂਬਰ ਮੁਹੰਮਦ ਜਾਵੇਦ ਅਤੇ AIMIM ਦੇ ਪ੍ਰਧਾਨ ਅਸਦੁੱਦੀਨ ਓਵੈਸੀ ਨੇ ਵਕ਼ਫ਼ (ਸੋਧ) ਬਿੱਲ 2025 ਦੀ ਸੰਵਿਧਾਨਕ ਵੈਧਤਾ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਚੁਣੌਤੀ ਦਿੱਤੀ ਹੈ।
ਕਾਂਗਰਸ ਦੇ ਸੰਸਦ ਮੈਂਬਰ ਮੁਹੰਮਦ ਜਾਵੇਦ ਅਤੇ ਆਲ ਇੰਡੀਆ ਮਜਲਿਸ-ਏ-ਇਤਿਹਾਦੁਲ ਮੁਸਲਿਮੀਨ (AIMIM) ਦੇ ਪ੍ਰਧਾਨ ਅਸਦੁੱਦੀਨ ਓਵੈਸੀ ਨੇ ਸ਼ੁੱਕਰਵਾਰ ਨੂੰ ਵਕ਼ਫ਼ (ਸੋਧ) ਬਿੱਲ 2025 ਦੀ ਸੰਵਿਧਾਨਕ ਵੈਧਤਾ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਚੁਣੌਤੀ ਦਿੱਤੀ। ਉਨ੍ਹਾਂ ਦਾ ਦਾਅਵਾ ਹੈ ਕਿ ਇਹ ਬਿੱਲ ਸੰਵਿਧਾਨਿਕ ਵਿਵਸਥਾਵਾਂ ਦੀ ਉਲੰਘਣਾ ਕਰਦਾ ਹੈ ਅਤੇ ਮੁਸਲਿਮ ਭਾਈਚਾਰੇ ਦੀ ਧਾਰਮਿਕ ਖੁਦਮੁਖਤਿਆਰੀ ਨੂੰ ਨੁਕਸਾਨ ਪਹੁੰਚਾਉਂਦਾ ਹੈ।
ਮੁਹੰਮਦ ਜਾਵੇਦ, ਜੋ ਬਿਹਾਰ ਦੇ ਕਿਸ਼ਨਗੰਜ ਤੋਂ ਲੋਕ ਸਭਾ ਮੈਂਬਰ ਹਨ, ਨੇ ਪਟੀਸ਼ਨ ਵਿੱਚ ਦੋਸ਼ ਲਾਇਆ ਕਿ ਇਹ ਸੋਧਾਂ ਵਕ਼ਫ਼ ਸੰਪਤੀਆਂ ਅਤੇ ਉਨ੍ਹਾਂ ਦੇ ਪ੍ਰਬੰਧਨ 'ਤੇ ਮਨਮਾਨੀਆਂ ਪਾਬੰਦੀਆਂ ਲਾਉਂਦੀਆਂ ਹਨ, ਜਿਸ ਨਾਲ ਮੁਸਲਿਮ ਭਾਈਚਾਰੇ ਦੀ ਧਾਰਮਿਕ ਖੁਦਮੁਖਤਿਆਰੀ ਕਮਜ਼ੋਰ ਹੁੰਦੀ ਹੈ। AIMIM ਦੇ ਪ੍ਰਧਾਨ ਅਸਦੁੱਦੀਨ ਓਵੈਸੀ ਨੇ ਵੀ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਕੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਇਹ ਬਿੱਲ ਵਕ਼ਫ਼ਾਂ ਨੂੰ ਪਹਿਲਾਂ ਮਿਲ ਰਹੀਆਂ ਸੁਰੱਖਿਆਵਾਂ ਨੂੰ ਹਟਾਉਂਦਾ ਹੈ ਅਤੇ ਹੋਰ ਧਾਰਮਿਕ ਅਤੇ ਚੈਰੀਟੇਬਲ ਸੰਸਥਾਵਾਂ ਨਾਲ ਵਿਤਕਰਾ ਕਰਦਾ ਹੈ।
ਇਹ ਬਿੱਲ ਸ਼ੁੱਕਰਵਾਰ ਨੂੰ ਰਾਜ ਸਭਾ ਵਿੱਚ 128 ਵੋਟਾਂ ਦੇ ਹੱਕ ਵਿੱਚ ਅਤੇ 95 ਵੋਟਾਂ ਦੇ ਵਿਰੋਧ ਵਿੱਚ ਪਾਸ ਹੋਇਆ, ਜਿਸ ਤੋਂ ਪਹਿਲਾਂ ਲੋਕ ਸਭਾ ਵਿੱਚ ਵੀ ਇਹ ਪਾਸ ਹੋਇਆ ਸੀ। ਹੁਣ ਇਹ ਬਿੱਲ ਰਾਸ਼ਟਰਪਤੀ ਦੀ ਮਨਜ਼ੂਰੀ ਦੀ ਉਡੀਕ ਕਰ ਰਿਹਾ ਹੈ।
Congress MP Mohammad Jawed and AIMIM chief Asaduddin Owaisi have approached the Supreme Court, challenging the constitutional validity of the Waqf (Amendment) Bill 2025. They argue that the bill infringes upon the fundamental rights of the Muslim community by imposing arbitrary restrictions on Waqf properties and undermining religious autonomy.
Mohammad Jawed, representing Kishanganj, Bihar, contends that the amendments disproportionately increase state intervention in Waqf affairs, violating constitutional provisions.Asaduddin Owaisi asserts that the bill removes protections previously accorded to Waqfs and discriminates against Muslim religious institutions.
The Waqf (Amendment) Bill 2025 was passed in the Rajya Sabha with 128 votes in favor and 95 against, following a 12-hour debate. The Lok Sabha had earlier approved the bill with 288 votes supporting and 232 opposing. The bill now awaits the President's assent to become law.
