ਬੇਅੰਤ ਸਿੰਘ ਕਤਲ ਕੇਸ - ਰਾਜੋਆਣਾ ਨੂੰ ਫਾਂਸੀ ਕਿਉਂ ਨਹੀਂ ਦਿੱਤੀ ਗਈ - ਸੁਪਰੀਮ ਕੋਰਟ
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਬੇਅੰਤ ਸਿੰਘ ਹੱਤਿਆ ਕੇਸ ਵਿੱਚ ਦੋਸ਼ੀ ਰਾਜੋਆਣਾ ਨੂੰ ਹੁਣ ਤੱਕ ਫਾਂਸੀ ਨਾ ਦੇਣ ਬਾਰੇ ਕੇਂਦਰ ਨੂੰ ਪੁੱਛਿਆ ਹੈ ਅਤੇ ਰਹਿਮ ਪਟੀਸ਼ਨ ਉੱਤੇ ਦੇਰੀ ਦਾ ਜ਼ਿਕਰ ਕੀਤਾ ਹੈ। ਰਾਜੋਆਣਾ 29 ਸਾਲਾਂ ਤੋਂ ਜੇਲ੍ਹ ਵਿੱਚ ਹੈ ਅਤੇ ਉਸ ਨੂੰ ਮੌਤ ਸਜ਼ਾ ਉਮਰ ਕੈਦ ਵਿੱਚ ਬਦਲਣ ਦੀ ਅਪੀਲ ਵਿੱਚ ਸੁਣਵਾਈ ਜਾਰੀ ਹੈ। ਅਗਲੀ ਸੁਣਵਾਈ 15 ਅਕਤੂਬਰ ਨੂੰ ਹੋਵੇਗੀ ਅਤੇ ਕੇਂਦਰ ਨੂੰ ਗੰਭੀਰ ਅਪਰਾਧ ਦਾ ਹਵਾਲਾ ਦਿੰਦੇ ਹੋਏ ਸਮਾਂ ਮੰਗਿਆ ਗਿਆ ਹੈ।
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਬੇਅੰਤ ਸਿੰਘ ਦੀ ਹੱਤਿਆ ਕੇਸ ਵਿੱਚ ਦੋਸ਼ੀ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਨੂੰ ਹੁਣ ਤੱਕ ਫਾਂਸੀ ਕਿਉਂ ਨਹੀਂ ਦਿੱਤੀ ਗਈ, ਇਸ ਬਾਰੇ ਕੇਂਦਰ ਨੂੰ ਪੁੱਛਿਆ ਹੈ। ਰਾਜੋਆਣਾ ਨੂੰ 1995 ਵਿੱਚ ਪੰਜਾਬ ਦੇ ਉਸ ਵੇਲੇ ਦੇ ਮੁੱਖ ਮੰਤਰੀ ਬੇਅੰਤ ਸਿੰਘ ਦੇ ਕਤਲ ਵਿੱਚ ਦੋਸ਼ੀ ਠਹਿਰਾਇਆ ਗਿਆ ਸੀ ਅਤੇ ਉਸ ਨੂੰ ਮੌਤ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਗਈ ਸੀ। ਉਹ ਪਿਛਲੇ 29 ਸਾਲਾਂ ਤੋਂ ਜੇਲ੍ਹ ਵਿੱਚ ਨਜ਼ਰਬੰਦ ਹੈ, ਜਿਸ ਵਿੱਚੋਂ 17 ਸਾਲ ਡੈਥ ਰੋ ਕਨਵਿਕਟ ਵਜੋਂ ਬਿਤਾਏ ਹਨ। ਜਸਟਿਸ ਵਿਕਰਮ ਨਾਥ, ਸੰਦੀਪ ਮਹਿਤਾ ਅਤੇ ਐੱਨ ਵੀ ਅੰਜਾਰੀਆ ਵਾਲੇ ਬੈਂਚ ਨੇ ਵਧੀਕ ਸਾਲਿਸਿਟਰ ਜਨਰਲ ਕੇ ਐੱਮ ਨਟਰਾਜ ਨੂੰ ਕਿਹਾ ਕਿ ਤੁਸੀਂ ਉਸ ਨੂੰ ਹੁਣ ਤੱਕ ਫਾਂਸੀ ਕਿਉਂ ਨਹੀਂ ਦਿੱਤੀ? ਇਸ ਲਈ ਕੌਣ ਜ਼ਿੰਮੇਵਾਰ ਹੈ? ਘੱਟੋ-ਘੱਟ ਅਸੀਂ ਫਾਂਸੀ ਉੱਤੇ ਰੋਕ ਨਹੀਂ ਲਗਾਈ ਹੈ। ਕੇਂਦਰ ਨੇ ਕਿਹਾ ਕਿ ਇਹ ਗੰਭੀਰ ਅਪਰਾਧ ਹੈ ਅਤੇ ਮਾਮਲਾ ਸੰਵੇਦਨਸ਼ੀਲ ਹੈ, ਜਿਸ ਕਾਰਨ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਫੈਸਲਾ ਲੈਣ ਵਿੱਚ ਦੇਰੀ ਹੋ ਰਹੀ ਹੈ।
ਸੁਪਰੀਮ ਕੋਰਟ ਰਾਜੋਆਣਾ ਦੀ ਮੌਤ ਦੀ ਸਜ਼ਾ ਨੂੰ ਉਮਰ ਕੈਦ ਵਿੱਚ ਬਦਲਣ ਦੀ ਅਪੀਲ ਉੱਤੇ ਸੁਣਵਾਈ ਕਰ ਰਹੀ ਹੈ। ਰਾਜੋਆਣਾ ਵੱਲੋਂ ਪੇਸ਼ ਹੋਏ ਸੀਨੀਅਰ ਵਕੀਲ ਮੁਕੁਲ ਰੋਹਤਗੀ ਨੇ ਕਿਹਾ ਕਿ ਉਨ੍ਹਾਂ ਦੇ ਮੁਵੱਕਲ ਦੀ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਅਜੇ ਤੱਕ ਕੋਈ ਫੈਸਲਾ ਨਹੀਂ ਹੋਇਆ ਹੈ। ਉਨ੍ਹਾਂ ਨੇ ਕਿਹਾ ਕਿ ਪਹਿਲਾਂ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਸਮੇਂ ਸਿਰ ਫੈਸਲਾ ਲੈਣ ਨੂੰ ਕਿਹਾ ਸੀ। ਰੋਹਤਗੀ ਨੇ ਵਧੇਰੇ ਕਿਹਾ ਕਿ ਰਾਜੋਆਣਾ ਨੇ ਖੁਦ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਨਹੀਂ ਦਾਇਰ ਕੀਤੀ, ਬਲਕਿ ਇਹ ਸ਼੍ਰੋਮਣੀ ਗੁਰਦੁਆਰਾ ਪ੍ਰਬੰਧਕ ਕਮੇਟੀ ਵੱਲੋਂ 2012 ਵਿੱਚ ਦਾਇਰ ਕੀਤੀ ਗਈ ਸੀ। ਬੈਂਚ ਨੇ ਕੇਸ ਨੂੰ 15 ਅਕਤੂਬਰ ਤੱਕ ਮੁਲਤਵੀ ਕਰ ਦਿੱਤਾ ਅਤੇ ਕਿਹਾ ਕਿ ਕੇਂਦਰ ਦੀ ਬੇਨਤੀ ਉੱਤੇ ਮੁਲਤਵੀ ਨਹੀਂ ਕੀਤਾ ਜਾ ਰਿਹਾ।
ਪਹਿਲਾਂ 20 ਜਨਵਰੀ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕੇਂਦਰ ਨੂੰ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਫੈਸਲਾ ਲੈਣ ਲਈ ਕਿਹਾ ਸੀ। ਕੇਂਦਰ ਨੇ ਉਸ ਵੇਲੇ ਵੀ ਮਾਮਲੇ ਦੀ ਸੰਵੇਦਨਸ਼ੀਲਤਾ ਦਾ ਹਵਾਲਾ ਦਿੰਦਿਆਂ ਕਿਹਾ ਸੀ ਕਿ ਇਹ ਵਿਚਾਰ ਕੀਤਾ ਜਾ ਰਿਹਾ ਹੈ। ਪਿਛਲੇ ਸਾਲ 25 ਸਤੰਬਰ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਰਾਜੋਆਣਾ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਕੇਂਦਰ, ਪੰਜਾਬ ਸਰਕਾਰ ਅਤੇ ਚੰਡੀਗੜ੍ਹ ਪ੍ਰਸ਼ਾਸਨ ਤੋਂ ਜਵਾਬ ਮੰਗੇ ਸਨ। ਰਾਜੋਆਣਾ ਬੱਬਰ ਖਾਲਸਾ ਆਗੂ ਸੀ ਅਤੇ ਉਸ ਨੂੰ ਬੰਬ ਧਮਾਕੇ ਵਿੱਚ ਬੇਅੰਤ ਸਿੰਘ ਅਤੇ 16 ਹੋਰ ਲੋਕਾਂ ਦੀ ਹੱਤਿਆ ਲਈ 2007 ਵਿੱਚ ਵਿਸ਼ੇਸ਼ ਅਦਾਲਤ ਨੇ ਮੌਤ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਸੀ। ਇਹ ਹੱਦਿਆ 31 ਅਗਸਤ 1995 ਨੂੰ ਚੰਡੀਗੜ੍ਹ ਵਿੱਚ ਸਿਵਲ ਸੈਕਟਰੇਟ ਵਿਖੇ ਹੋਈ ਸੀ। 3 ਮਈ 2023 ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਉਸ ਦੀ ਮੌਤ ਸਜ਼ਾ ਘਟਾਉਣ ਤੋਂ ਇਨਕਾਰ ਕੀਤਾ ਸੀ ਅਤੇ ਕਿਹਾ ਸੀ ਕਿ ਰਹਿਮ ਦੀ ਪਟੀਸ਼ਨ ਉੱਤੇ ਅਥਾਰਟੀ ਵਿਚਾਰ ਕਰ ਸਕਦੀ ਹੈ। ਰਾਜੋਆਣਾ ਨੇ ਆਪਣੀ ਪਟੀਸ਼ਨ ਵਿੱਚ 29 ਸਾਲ ਜੇਲ੍ਹ ਵਿੱਚ ਰਹਿਣ ਅਤੇ 2.5 ਸਾਲ ਇਕੱਲੇ ਬੰਦ ਹੋਣ ਦਾ ਜ਼ਿਕਰ ਕੀਤਾ ਹੈ।
The Supreme Court has asked the Centre why Balwant Singh Rajoana, convicted in the Beant Singh murder case, has not been hanged till now. Rajoana was held guilty in the 1995 assassination of Punjab's then Chief Minister Beant Singh and sentenced to death. He has been in jail for the past 29 years, including 17 years as a death row convict. The bench of Justices Vikram Nath, Sandeep Mehta, and N V Anjaria told Additional Solicitor General K M Nataraj that why have you not hanged him till now? Who is responsible for this? At least, we have not stayed the execution. The Centre said it is a serious offence and the matter is sensitive, due to which the decision on the mercy petition is delayed.
The Supreme Court is hearing Rajoana's appeal to convert his death sentence to life imprisonment. Senior advocate Mukul Rohatgi, appearing for Rajoana, said that no decision has been taken on his client's mercy petition yet. He said that the Supreme Court had previously directed to decide the mercy petition in time. Rohatgi further said that Rajoana himself did not file the mercy petition, but it was filed by the Shiromani Gurdwara Parbandhak Committee in 2012. The bench adjourned the case till October 15 and said that it is not being adjourned on the Centre's request.
Earlier, on January 20, the Supreme Court had asked the Centre to decide on the mercy petition. The Centre had then also cited the sensitivity of the matter and said that it is being considered. Last year on September 25, the Supreme Court had sought responses from the Centre, Punjab government, and Chandigarh administration on Rajoana's petition. Rajoana was a Babbar Khalsa leader and was sentenced to death by a special court in 2007 for the bomb blast in which Beant Singh and 16 others were killed. This incident happened on August 31, 1995, outside the Civil Secretariat in Chandigarh. On May 3, 2023, the Supreme Court refused to reduce his death sentence and said that the authority can consider the mercy petition. In his petition, Rajoana mentioned spending 29 years in jail and 2.5 years in solitary confinement.
