ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਸਵਾਲ: ਚੀਨ ਨੇ ਭਾਰਤੀ ਜ਼ਮੀਨ ’ਤੇ ਕਬਜ਼ਾ ਕੀਤਾ, ਤੁਹਾਨੂੰ ਕਿਵੇਂ ਪਤਾ?
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ਨੂੰ ਭਾਰਤ ਜੋੜੋ ਯਾਤਰਾ ਦੌਰਾਨ ਚੀਨ ਅਤੇ ਭਾਰਤੀ ਫੌਜ ’ਤੇ ਕੀਤੀਆਂ ਟਿੱਪਣੀਆਂ ਲਈ ਝਾੜ ਪਾਈ ਅਤੇ ਪੁੱਛਿਆ ਕਿ ਉਨ੍ਹਾਂ ਨੂੰ ਚੀਨ ਵੱਲੋਂ 2,000 ਵਰਗ ਕਿਲੋਮੀਟਰ ਭਾਰਤੀ ਜ਼ਮੀਨ ’ਤੇ ਕਬਜ਼ੇ ਦੀ ਜਾਣਕਾਰੀ ਕਿਵੇਂ ਮਿਲੀ। ਅਦਾਲਤ ਨੇ ਲਖਨਊ ਦੀ ਅਦਾਲਤ ਵਿੱਚ ਰਾਹੁਲ ਗਾਂਧੀ ਵਿਰੁੱਧ ਜਾਰੀ ਕਾਰਵਾਈ ’ਤੇ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਅਤੇ ਉੱਤਰ ਪ੍ਰਦੇਸ਼ ਸਰਕਾਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕੀਤਾ। ਭਾਜਪਾ ਅਤੇ ਕਾਂਗਰਸ ਨੇ ਇਸ ਮੁੱਦੇ ’ਤੇ ਇੱਕ-ਦੂਜੇ ’ਤੇ ਤਿੱਖੇ ਹਮਲੇ ਕੀਤੇ।
ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕਾਂਗਰਸ ਦੇ ਨੇਤਾ ਰਾਹੁਲ ਗਾਂਧੀ ਨੂੰ ਭਾਰਤ ਜੋੜੋ ਯਾਤਰਾ ਦੌਰਾਨ ਭਾਰਤੀ ਫੌਜ ਅਤੇ ਚੀਨ ਦੇ ਮੁੱਦੇ ’ਤੇ ਕੀਤੀਆਂ ਟਿੱਪਣੀਆਂ ਲਈ ਸਖ਼ਤ ਸ਼ਬਦਾਂ ਵਿੱਚ ਝਾੜ ਪਾਈ। ਅਦਾਲਤ ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ਤੋਂ ਪੁੱਛਿਆ ਕਿ ਉਨ੍ਹਾਂ ਨੂੰ ਕਿਵੇਂ ਪਤਾ ਕਿ ਚੀਨ ਨੇ ਭਾਰਤ ਦੀ 2,000 ਵਰਗ ਕਿਲੋਮੀਟਰ ਜ਼ਮੀਨ ’ਤੇ ਕਬਜ਼ਾ ਕੀਤਾ ਹੈ। ਜਸਟਿਸ ਦੀਪਾਂਕਰ ਦੱਤਾ ਅਤੇ ਜਸਟਿਸ ਆਗਸਟੀਨ ਜੌਰਜ ਮਸੀਹ ਦੀ ਬੈਂਚ ਨੇ ਕਿਹਾ, “ਜੇ ਤੁਸੀਂ ਸੱਚੇ ਭਾਰਤੀ ਹੋ ਤਾਂ ਅਜਿਹੀਆਂ ਗੱਲਾਂ ਨਹੀਂ ਕਰੋਗੇ।” ਅਦਾਲਤ ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ਨੂੰ ਸਵਾਲ ਕੀਤਾ ਕਿ ਉਹ ਸੰਸਦ ਵਿੱਚ ਇਹ ਮੁੱਦੇ ਕਿਉਂ ਨਹੀਂ ਉਠਾਉਂਦੇ ਅਤੇ ਸੋਸ਼ਲ ਮੀਡੀਆ ’ਤੇ ਅਜਿਹੇ ਬਿਆਨ ਕਿਉਂ ਦਿੰਦੇ ਹਨ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਪੁੱਛਿਆ, “ਕੀ ਤੁਸੀਂ ਉੱਥੇ ਮੌਜੂਦ ਸੀ? ਕੀ ਤੁਹਾਡੇ ਕੋਲ ਕੋਈ ਭਰੋਸੇਯੋਗ ਸਬੂਤ ਹੈ?” ਅਦਾਲਤ ਨੇ ਇਹ ਵੀ ਕਿਹਾ ਕਿ ਬਿਨਾਂ ਸਬੂਤਾਂ ਦੇ ਅਜਿਹੇ ਬਿਆਨ ਦੇਣੇ ਨਹੀਂ ਚਾਹੀਦੇ।
ਹਾਲਾਂਕਿ, ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਲਖਨਊ ਦੀ ਅਦਾਲਤ ਵਿੱਚ ਰਾਹੁਲ ਗਾਂਧੀ ਵਿਰੁੱਧ ਜਾਰੀ ਕਾਰਵਾਈ ’ਤੇ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਹੈ। ਅਦਾਲਤ ਨੇ ਉੱਤਰ ਪ੍ਰਦੇਸ਼ ਸਰਕਾਰ ਅਤੇ ਸ਼ਿਕਾਇਤਕਰਤਾ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕੀਤਾ ਹੈ। ਰਾਹੁਲ ਗਾਂਧੀ ਦੀ ਤਰਫੋਂ ਪੇਸ਼ ਹੋਏ ਸੀਨੀਅਰ ਵਕੀਲ ਅਭਿਸ਼ੇਕ ਸਿੰਘਵੀ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਵਿਰੋਧੀ ਧਿਰ ਦੇ ਨੇਤਾ ਦਾ ਮੁੱਦੇ ਉਠਾਉਣਾ ਜ਼ਰੂਰੀ ਹੈ, ਨਹੀਂ ਤਾਂ ਇਹ ਮੰਦਭਾਗੀ ਸਥਿਤੀ ਹੋਵੇਗੀ। ਸਿੰਘਵੀ ਨੇ ਕਿਹਾ ਕਿ ਰਾਹੁਲ ਗਾਂਧੀ ਨੇ ਸਿਰਫ਼ ਸਰਕਾਰ ਵੱਲੋਂ ਸੂਚਨਾ ਦਬਾਉਣ ਅਤੇ ਗਲਵਾਨ ਘਾਟੀ ਵਿੱਚ 20 ਭਾਰਤੀ ਫੌਜੀਆਂ ਦੀ ਮੌਤ ਦੇ ਮੁੱਦੇ ’ਤੇ ਚਿੰਤਾ ਜ਼ਾਹਰ ਕੀਤੀ ਸੀ। ਅਦਾਲਤ ਨੇ ਜਵਾਬ ਵਿੱਚ ਕਿਹਾ ਕਿ ਸਰਹੱਦੀ ਸੰਘਰਸ਼ ਵਿੱਚ ਦੋਵਾਂ ਧਿਰਾਂ ਨੂੰ ਨੁਕਸਾਨ ਹੋਣਾ ਕੋਈ ਅਸਧਾਰਨ ਗੱਲ ਨਹੀਂ ਹੈ। ਜਸਟਿਸ ਦੱਤਾ ਨੇ ਕਿਹਾ ਕਿ ਵਿਰੋਧੀ ਧਿਰ ਦੇ ਨੇਤਾ ਵਜੋਂ ਰਾਹੁਲ ਗਾਂਧੀ ਨੂੰ ਜ਼ਿੰਮੇਵਾਰੀ ਨਾਲ ਬਿਆਨ ਦੇਣੇ ਚਾਹੀਦੇ ਅਤੇ ਸੰਸਦ ਵਰਗੇ ਸਹੀ ਮੰਚ ’ਤੇ ਮੁੱਦੇ ਉਠਾਉਣੇ ਚਾਹੀਦੇ।
ਭਾਰਤੀ ਜਨਤਾ ਪਾਰਟੀ (ਭਾਜਪਾ) ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ’ਤੇ ਨਿਸ਼ਾਨਾ ਸਾਧਦਿਆਂ ਦੋਸ਼ ਲਾਇਆ ਕਿ ਉਹ ਅਤੇ ਕਾਂਗਰਸ ਪਾਰਟੀ ਭਾਰਤੀ ਫੌਜ ਨੂੰ ਨਫ਼ਰਤ ਕਰਦੇ ਹਨ। ਭਾਜਪਾ ਦੇ ਆਈਟੀ ਸੈੱਲ ਮੁਖੀ ਅਮਿਤ ਮਾਲਵੀਆ ਨੇ ਸੋਸ਼ਲ ਮੀਡੀਆ ’ਤੇ ਕਿਹਾ ਕਿ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ਨੂੰ ਕੌਮੀ ਸੁਰੱਖਿਆ ਅਤੇ ਖੇਤਰੀ ਅਖੰਡਤਾ ’ਤੇ ਗੈਰ-ਜ਼ਿੰਮੇਵਾਰ ਬਿਆਨ ਦੇਣ ਲਈ ਕਈ ਵਾਰ ਝਾੜ ਪਾਈ ਹੈ। ਉਨ੍ਹਾਂ ਨੇ ਰਾਹੁਲ ਗਾਂਧੀ ਦੀਆਂ ਹੋਰ ਟਿੱਪਣੀਆਂ, ਜਿਵੇਂ ‘ਬੇਜਾਨ ਅਰਥਚਾਰਾ’, ਨੂੰ ਵੀ ਗਲਤ ਕਰਾਰ ਦਿੱਤਾ। ਦੂਜੇ ਪਾਸੇ, ਕਾਂਗਰਸ ਨੇ ਜਵਾਬ ਵਿੱਚ ਕਿਹਾ ਕਿ 2020 ਦੀ ਗਲਵਾਨ ਘਾਟੀ ਦੀ ਘਟਨਾ ਤੋਂ ਬਾਅਦ ਹਰ ਭਾਰਤੀ ਸਰਕਾਰ ਤੋਂ ਚੀਨ ਮੁੱਦੇ ’ਤੇ ਸਪੱਸ਼ਟ ਜਵਾਬ ਮੰਗ ਰਿਹਾ ਹੈ। ਕਾਂਗਰਸ ਦੇ ਜਨਰਲ ਸਕੱਤਰ ਜੈਰਾਮ ਰਮੇਸ਼ ਨੇ ਦੋਸ਼ ਲਾਇਆ ਕਿ ਮੋਦੀ ਸਰਕਾਰ ਨੇ ‘ਡੀਡੀਐੱਲਜੇ’ ਨੀਤੀ—ਇਨਕਾਰ, ਧਿਆਨ ਭਟਕਾਉਣਾ, ਝੂਠ ਬੋਲਣਾ ਅਤੇ ਸਹੀ ਠਹਿਰਾਉਣਾ—ਨਾਲ ਸੱਚਾਈ ਨੂੰ ਲੁਕਾਇਆ ਹੈ। ਉਨ੍ਹਾਂ ਨੇ ਇਹ ਵੀ ਕਿਹਾ ਕਿ ਮੋਦੀ ਸਰਕਾਰ 1962 ਤੋਂ ਬਾਅਦ ਸਭ ਤੋਂ ਵੱਡੇ ਖੇਤਰੀ ਝਟਕੇ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਹੈ।
The Supreme Court sharply criticized Congress leader Rahul Gandhi for his remarks made during the Bharat Jodo Yatra regarding the Indian Army and China, questioning how he knew that China had occupied 2,000 square kilometers of Indian land. The bench of Justice Dipankar Datta and Justice Augustine George Masih stated, “If you are a true Indian, you would not make such statements.” The court asked Rahul Gandhi why he did not raise these issues in Parliament and instead made such claims on social media. The Supreme Court further questioned, “Were you present there? Do you have any credible evidence?” The court emphasized that such statements should not be made without proof.
However, the Supreme Court stayed the proceedings against Rahul Gandhi in a Lucknow court and issued notices to the Uttar Pradesh government and the complainant. Representing Rahul Gandhi, senior advocate Abhishek Singhvi argued that it is essential for the Leader of the Opposition to raise issues, or it would be an unfortunate situation. Singhvi stated that Rahul Gandhi was only expressing concern over the suppression of information and the death of 20 Indian soldiers in the Galwan Valley clash. The court responded that losses on both sides in a border conflict are not unusual. Justice Datta noted that as a responsible opposition leader, Rahul Gandhi should make statements responsibly and raise issues on appropriate platforms like Parliament.
The Bharatiya Janata Party (BJP) targeted Rahul Gandhi, alleging that he and the Congress party harbor hatred toward the Indian Army. BJP IT cell chief Amit Malviya stated on social media that the Supreme Court has repeatedly reprimanded Rahul Gandhi for making irresponsible statements on national security and territorial integrity. He also criticized Gandhi’s recent “lifeless economy” remark, calling it a “diplomatic disaster.” In response, Congress stated that since the 2020 Galwan Valley incident, every patriotic Indian has been seeking answers from the government on the China issue. Congress general secretary Jairam Ramesh accused the Modi government of hiding the truth through its “DDLJ” policy—denial, distraction, lying, and justification. He further alleged that the Modi government is responsible for the biggest territorial setback since 1962.
