73 ਸਾਲ ਦੀ ਬਜ਼ੁਰਗ ਔਰਤ ਨੂੰ 33 ਸਾਲ ਬਾਅਦ ਅਮਰੀਕਾ ਵਿੱਚੋਂ ਭਾਰਤ ਭੇਜਿਆ ਗਿਆ

73 ਸਾਲਾਂ ਦੀ ਬਜ਼ੁਰਗ ਔਰਤ ਹਰਜੀਤ ਕੌਰ ਨੂੰ ਇਸ ਹਫ਼ਤੇ ਦੇ ਸ਼ੁਰੂ ਵਿੱਚ ਅਮਰੀਕਾ ਤੋਂ ਭਾਰਤ ਵਾਪਸ ਭੇਜ ਦਿੱਤਾ ਗਿਆ। ਉਹ ਪਿਛਲੇ 33 ਸਾਲਾਂ ਤੋਂ ਵੱਧ ਸਮੇਂ ਤੋਂ ਉੱਤਰੀ ਕੈਲੀਫੋਰਨੀਆ ਦੇ ਈਸਟ ਬੇ ਖੇਤਰ ਵਿੱਚ ਰਹਿ ਰਹੀ ਸੀ। ਉਸ ਦੇ ਵਕੀਲ ਨੇ ਦੱਸਿਆ ਕਿ ਕੈਲੀਫੋਰਨੀਆ ਵਿੱਚ ਇਮੀਗ੍ਰੇਸ਼ਨ ਅਧਿਕਾਰੀਆਂ ਵੱਲੋਂ ਹਿਰਾਸਤ ਵਿੱਚ ਲੈਣ ਤੋਂ ਬਾਅਦ ਉਸ ਨੂੰ ਆਪਣੇ ਪਰਿਵਾਰ ਅਤੇ ਰਿਸ਼ਤੇਦਾਰਾਂ ਨੂੰ ਅਲਵਿਦਾ ਕਹਿਣ ਦਾ ਮੌਕਾ ਵੀ ਨਹੀਂ ਦਿੱਤਾ ਗਿਆ। ਹਰਜੀਤ ਕੌਰ, ਜੋ ਤਰਨ ਤਾਰਨ ਜ਼ਿਲ੍ਹੇ ਦੇ ਪੰਗੋਟਾ ਗੁਆਂਢ ਵਾਸੀ ਹੈ, 1992 ਵਿੱਚ ਆਪਣੇ ਪਤੀ ਦੀ ਮੌਤ ਤੋਂ ਬਾਅਦ ਆਪਣੇ ਦੋ ਨਾਬਾਲਗ ਪੁੱਤਰਾਂ ਨਾਲ ਅਮਰੀਕਾ ਗਈ ਸੀ। ਉਹ ਇੱਕ ਸਾਰੀ ਦੁਕਾਨ ਵਿੱਚ ਸਿਲਾਈ ਕੰਮ ਕਰਦੀ ਸੀ ਅਤੇ ਆਪਣੇ ਟੈਕਸ ਵੀ ਭਰਦੀ ਸੀ।

ਵਕੀਲ ਦੀਪਕ ਆਹਲੂਵਾਲੀਆ ਨੇ ਇੰਸਟਾਗ੍ਰਾਮ ਪੋਸਟ ਵਿੱਚ ਕਿਹਾ ਕਿ ਬੀਬੀ ਜੀ (ਹਰਜੀਤ ਕੌਰ) ਪੰਜਾਬ ਵਾਪਸ ਆ ਗਏ ਹਨ ਅਤੇ ਉਹ ਪਹਿਲਾਂ ਹੀ ਭਾਰਤ ਵਿੱਚ ਉਤਰ ਚੁੱਕੇ ਹਨ। ਉਸ ਨੂੰ 8 ਸਤੰਬਰ ਨੂੰ ਕੈਲੀਫੋਰਨੀਆ ਵਿੱਚ ਇਮੀਗ੍ਰੇਸ਼ਨ ਅਤੇ ਕਸਟਮਜ਼ ਐਨਫੋਰਸਮੈਂਟ (ਆਈਸੀਈ) ਦੇ ਅਧਿਕਾਰੀਆਂ ਨੇ ਰੁਟੀਨ ਜਾਂਚ ਲਈ ਜਦੋਂ ਉਹ ਸਾਂ ਫਰਾਂਸਿਸਕੋ ਦਫ਼ਤਰ ਗਈ ਸੀ, ਤਾਂ ਹਿਰਾਸਤ ਵਿੱਚ ਲੈ ਲਿਆ ਸੀ। ਇਸ ਕਾਰਨ ਉਸ ਦੇ ਪਰਿਵਾਰ ਨੇ ਭਾਈਚਾਰੇ ਦੇ ਸੈਂਕੜੇ ਲੋਕਾਂ ਨਾਲ ਮਿਲ ਕੇ ਵਿਰੋਧ ਪ੍ਰਦਰਸ਼ਨ ਕੀਤੇ, ਜਿਸ ਵਿੱਚ ਉਸ ਦੀ ਤੁਰੰਤ ਰਿਹਾਈ ਦੀ ਮੰਗ ਕੀਤੀ ਗਈ। ਪ੍ਰਦਰਸ਼ਨਾਂ ਵਿੱਚ ਕੈਲੀਫੋਰਨੀਆ ਦੇ ਸੈਨੇਟਰ ਜੈਸੀ ਅਰੈਗੁਇਨ ਅਤੇ ਕਾਂਗਰਸਮੈਨ ਜੌਹਨ ਗਾਰਾਮੈਂਡੀ ਵਰਗੇ ਆਗੂ ਵੀ ਸ਼ਾਮਲ ਹੋਏ, ਜਿਨ੍ਹਾਂ ਨੇ ਇਸ ਨੂੰ ਗਲਤ ਤਰੀਕੇ ਨਾਲ ਲੱਗੂ ਅਤੇ ਨੀਤੀਗਤ ਗਲਤੀ ਦੱਸਿਆ।

ਹਰਜੀਤ ਕੌਰ ਨੂੰ ਆਈਸੀਈ ਨੇ ਹੋਰ ਕਾਗਜ਼ਾਂ ਲਈ ਆਪਣੇ ਸਾਂ ਫਰਾਂਸਿਸਕੋ ਦਫ਼ਤਰ ਆਉਣ ਲਈ ਕਿਹਾ ਸੀ, ਪਰ ਉੱਥੇ ਪਹੁੰਚਣ ਤੇ ਉਸ ਨੂੰ ਹਿਰਾਸਤ ਵਿੱਚ ਲੈ ਲਿਆ ਗਿਆ। ਉਸ ਨੇ 1992 ਵਿੱਚ ਆਸ਼ਰੇ ਦੀ ਅਰਜ਼ੀ ਦਿੱਤੀ ਸੀ, ਜੋ 2012 ਵਿੱਚ ਨਾਇਨਥ ਸਰਕਿਟ ਅਦਾਲਤ ਵੱਲੋਂ ਰੱਦ ਕਰ ਦਿੱਤੀ ਗਈ। ਉਸ ਤੋਂ ਬਾਅਦ ਵੀ ਉਹ ਹਰ ਛੇ ਮਹੀਨੇ ਵਿੱਚ ਆਈਸੀਈ ਨਾਲ ਰਿਪੋਰਟਿੰਗ ਕਰਦੀ ਰਹੀ ਅਤੇ ਆਪਣੀ ਨੌਕਰੀ ਦੀ ਇਜਾਜ਼ਤ ਵੀ ਹਰ ਸਾਲ ਨਵੀਂ ਕੀਤੀ ਜਾਂਦੀ ਰਹੀ। ਡਿਪੋਰਟੇਸ਼ਨ ਦੇ ਬਾਵਜੂਦ ਉਸ ਨੂੰ ਭਾਰਤ ਵਾਪਸ ਜਾਣ ਲਈ ਭਾਰਤੀ ਕੌਂਸਲੇਟ ਤੋਂ ਯਾਤਰਾ ਦਸਤਾਵੇਜ਼ ਨਹੀਂ ਮਿਲੇ, ਜਿਸ ਕਾਰਨ ਉਹ ਖੁਦ ਵਾਪਸ ਨਹੀਂ ਜਾ ਸਕੀ। ਉਸ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਆਪਣੇ ਪਰਿਵਾਰ ਨਾਲ ਰਹਿਣ ਲਈ ਤਿਆਰ ਸੀ, ਪਰ ਉਨ੍ਹਾਂ ਨੇ ਉਸ ਨੂੰ ਐਂਕਲ ਮਾਨੀਟਰ ਲਗਾ ਕੇ ਛੱਡਣ ਦੀ ਪਰੋਂ ਇਹ ਵੀ ਨਹੀਂ ਕੀਤਾ।

ਡਿਪੋਰਟੇਸ਼ਨ ਦੌਰਾਨ ਉਸ ਨਾਲ ਬੁਰਾ ਵਿਵਹਾਰ ਕੀਤਾ ਗਿਆ। ਵਕੀਲ ਨੇ ਦੱਸਿਆ ਕਿ ਬੇਕਰਸਫੀਲਡ ਤੋਂ ਲਾਸ ਐਂਜਲਸ ਲਿਜਾਣ ਵੇਲੇ ਉਸ ਨੂੰ ਹੱਥਕੜੀਆਂ ਪਾ ਦਿੱਤੀਆਂ ਗਈਆਂ ਅਤੇ ਉਸ ਨੂੰ ਬੇਸੁਖੀਆਂ ਵਾਲੇ ਕੰਧ ਵਾਲੇ ਕਮਰੇ ਵਿੱਚ ਬੰਦ ਕੀਤਾ ਗਿਆ। ਉਸ ਨੂੰ ਬੁਨਿਆਦੀ ਸਹੂਲਤਾਂ ਜਿਵੇਂ ਟਾਇਲਟ ਪੇਪਰ ਅਤੇ ਨਹਾਉਣ ਦਾ ਮੌਕਾ ਵੀ ਨਹੀਂ ਦਿੱਤਾ ਗਿਆ। ਫਲਾਈਟ ਤੋਂ ਪਹਿਲਾਂ ਉਸ ਨੂੰ ਵੈੱਟ ਵਾਈਪਸ ਦਿੱਤੇ ਗਏ। ਫਲਾਈਟ ਵਿੱਚ ਉਸ ਨੂੰ ਆਈਸ ਵਾਲੀ ਪਲੇਟ ਦਿੱਤੀ ਗਈ ਅਤੇ ਦਵਾਈਆਂ ਵੀ ਨਹੀਂ ਦਿੱਤੀਆਂ ਗਈਆਂ, ਜਿਸ ਕਾਰਨ ਉਹ ਚੱਲ ਨਹੀਂ ਪਾ ਰਹੀ। ਉਹ 23 ਸਤੰਬਰ ਨੂੰ ਨਵੀਂ ਦਿੱਲੀ ਪਹੁੰਚੀ ਅਤੇ ਹੁਣ ਆਪਣੀ ਭੈਣ ਦੇ ਘਰ ਮੋਹਾਲੀ ਜਾ ਰਹੀ ਹੈ। ਉਸ ਨੇ ਕਿਹਾ ਕਿ ਇਹ ਸਭ ਤੋਂ ਬੁਰੀ ਘਟਨਾ ਹੈ ਅਤੇ ਉਹ ਇਸ ਨਾਲ ਮਰਨ ਨਾਲੋਂ ਬਿਹਤਰ ਮੰਨਦੀ ਹੈ। ਉਸ ਦੇ ਪਰਿਵਾਰ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਉਨ੍ਹਾਂ ਤੋਂ ਵਿਛੜ ਗਈ ਹੈ ਅਤੇ ਇਹ ਬਹੁਤ ਦੁਖਦਾਈ ਹੈ। ਆਈਸੀਈ ਨੇ ਕਿਹਾ ਕਿ ਉਸ ਨੇ ਸਾਰੀਆਂ ਅਪੀਲਾਂ ਹਾਰ ਲਈਆਂ ਹਨ ਅਤੇ ਹੁਣ ਅਮਰੀਕੀ ਕਾਨੂੰਨ ਅਨੁਸਾਰ ਡਿਪੋਰਟ ਕੀਤਾ ਗਿਆ ਹੈ। ਸਿੱਖ ਕੋਲੀਸ਼ਨ ਵਰਗੀਆਂ ਸੰਸਥਾਵਾਂ ਨੇ ਇਸ ਨੂੰ ਅਨੁਚਿਤ ਅਤੇ ਬੇਰਹਿਮੀ ਵਾਲਾ ਕਾਰਵਾਈ ਦੱਸਿਆ ਹੈ, ਖਾਸ ਕਰਕੇ ਉਸ ਦੀ ਉਮਰ, ਵਿਧਵਾ ਹੋਣ ਅਤੇ ਬਲੱਡ ਪ੍ਰੈਸ਼ਰ ਅਤੇ ਡਾਇਬਟੀਜ਼ ਵਰਗੀਆਂ ਬਿਮਾਰੀਆਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦੇ ਹੋਏ। ਵਕੀਲ ਨੇ ਡਿਪੋਰਟੇਸ਼ਨ ਦੇ ਸ਼ਰਤਾਂ ਬਾਰੇ ਸ਼ਿਕਾਇਤ ਵੀ ਦਰਜ ਕਰਨ ਦੀ ਗੱਲ ਕੀਤੀ ਹੈ।

A 73-year-old elderly woman, Harjeet Kaur, was sent back from the US to India at the beginning of this week. She had been living in the East Bay area of Northern California for more than 33 years. Her lawyer said that after being taken into custody by immigration officials in California, she was not even given the opportunity to say goodbye to her family and relatives. Harjeet Kaur, a resident of Pangota village in Tarn Taran district of Punjab, went to the US in 1992 with her two minor sons after the death of her husband. She worked as a seamstress in a sari shop and paid her taxes.

Lawyer Deepak Ahluwalia said in an Instagram post that Bibi Ji (Harjeet Kaur) has returned to Punjab and has already landed in India. She was taken into custody by Immigration and Customs Enforcement (ICE) officials in California on September 8 when she went for a routine check to the San Francisco office, due to which her family organized protests. Hundreds of community members joined the protests, demanding her immediate release. Leaders like California Senator Jesse Arreguin and Congressman John Garamendi also participated, calling it a misplaced priority and policy mistake.

ICE had asked Harjeet Kaur to come to their San Francisco office for additional paperwork, but upon arrival, she was detained. She had applied for asylum in 1992, which was rejected by the Ninth Circuit Court in 2012. Even after that, she continued to report to ICE every six months and her work permit was renewed annually. Despite the deportation order, she could not return to India because she could not obtain travel documents from the Indian Consulate. She said she was willing to stay with her family, but they did not even release her with an ankle monitor.

She was treated badly during the deportation. The lawyer said that while being taken from Bakersfield to Los Angeles, she was handcuffed and locked in a room with bare concrete walls without facilities. She was not given basic amenities like toilet paper or a chance to shower. Before the flight, she was given wet wipes. On the flight, she was given a plate of ice and was not given her medicines, due to which she could not even walk. She arrived in New Delhi on September 23 and is now going to her sister's house in Mohali. She said that this is the worst incident and she considers it better to die than face this. Her family said that she has been separated from them and it is very heartbreaking. ICE said that she lost all her appeals and now she has been deported in accordance with US law. Organizations like the Sikh Coalition have called it unacceptable and inhumane, especially considering her age, widowhood, and medical conditions like high blood pressure and diabetes. The lawyer has said that a complaint will be filed regarding the conditions of deportation.
