ਦਿੱਲੀ ਦੰਗੇ ਮਾਮਲਾ: ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਉਮਰ ਖਾਲਿਦ ਅਤੇ ਸ਼ਰਜੀਲ ਇਮਾਮ ਦੀ ਜ਼ਮਾਨਤ ਅਰਜ਼ੀ ਰੱਦ ਕੀਤੀ
ਸਾਲ 2020 ਦੇ ਦਿੱਲੀ ਦੰਗਿਆਂ ਨਾਲ ਸਬੰਧਤ ਸਾਜ਼ਿਸ਼ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਉਮਰ ਖਾਲਿਦ ਅਤੇ ਸ਼ਰਜੀਲ ਇਮਾਮ ਨੂੰ ਜ਼ਮਾਨਤ ਦੇਣ ਤੋਂ ਸਾਫ਼ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ ਹੈ। ਅਦਾਲਤ ਨੇ ਦੋਵਾਂ ਦੀਆਂ ਅਰਜ਼ੀਆਂ ਨੂੰ ਖਾਰਜ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਮਾਮਲੇ ਦੀ ਗੰਭੀਰਤਾ ਨੂੰ ਦੇਖਦੇ ਹੋਏ ਅਜੇ ਰਾਹਤ ਨਹੀਂ ਦਿੱਤੀ ਜਾ ਸਕਦੀ। ਇਹ ਦੋਵੇਂ ਮੁਲਜ਼ਮ ਲੰਬੇ ਸਮੇਂ ਤੋਂ ਜੇਲ੍ਹ ਵਿੱਚ ਬੰਦ ਹਨ ਅਤੇ ਉਨ੍ਹਾਂ ਵਿਰੁੱਧ ਯੂਏਪੀਏ (UAPA) ਤਹਿਤ ਮਾਮਲਾ ਚੱਲ ਰਿਹਾ ਹੈ
ਦੇਸ਼ ਦੀ ਸਰਵਉੱਚ ਅਦਾਲਤ ਨੇ ਸਾਲ 2020 ਵਿੱਚ ਹੋਏ ਦਿੱਲੀ ਦੰਗਿਆਂ ਦੀ ਵੱਡੀ ਸਾਜ਼ਿਸ਼ ਨਾਲ ਜੁੜੇ ਮਾਮਲੇ ਵਿੱਚ ਅਹਿਮ ਫੈਸਲਾ ਸੁਣਾਇਆ ਹੈ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਜੇਲ੍ਹ ਵਿੱਚ ਬੰਦ ਜੇਐਨਯੂ (JNU) ਦੇ ਸਾਬਕਾ ਵਿਦਿਆਰਥੀ ਉਮਰ ਖਾਲਿਦ ਅਤੇ ਸ਼ਰਜੀਲ ਇਮਾਮ ਦੀਆਂ ਜ਼ਮਾਨਤ ਅਰਜ਼ੀਆਂ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਹੈ। ਅਦਾਲਤ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਉਨ੍ਹਾਂ ਵਿਰੁੱਧ ਲੱਗੇ ਦੋਸ਼ਾਂ ਦੀ ਪ੍ਰਕਿਰਤੀ ਅਤੇ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਸਬੂਤਾਂ ਦੇ ਆਧਾਰ 'ਤੇ ਇਸ ਪੜਾਅ 'ਤੇ ਜ਼ਮਾਨਤ ਦੇਣਾ ਉਚਿਤ ਨਹੀਂ ਹੈ।
ਉਮਰ ਖਾਲਿਦ ਅਤੇ ਸ਼ਰਜੀਲ ਇਮਾਮ 'ਤੇ ਦਿੱਲੀ ਦੰਗਿਆਂ ਦੌਰਾਨ ਹਿੰਸਾ ਭੜਕਾਉਣ ਅਤੇ ਦੇਸ਼ ਵਿਰੋਧੀ ਸਾਜ਼ਿਸ਼ ਰਚਣ ਦੇ ਗੰਭੀਰ ਦੋਸ਼ ਲੱਗੇ ਸਨ। ਦਿੱਲੀ ਪੁਲਿਸ ਨੇ ਇਨ੍ਹਾਂ ਵਿਰੁੱਧ ਗੈਰ-ਕਾਨੂੰਨੀ ਗਤੀਵਿਧੀਆਂ (ਰੋਕੂ) ਐਕਟ ਯਾਨੀ ਯੂਏਪੀਏ (UAPA) ਦੀਆਂ ਸਖ਼ਤ ਧਾਰਾਵਾਂ ਤਹਿਤ ਕੇਸ ਦਰਜ ਕੀਤਾ ਹੋਇਆ ਹੈ। ਜਾਂਚ ਏਜੰਸੀਆਂ ਨੇ ਅਦਾਲਤ ਵਿੱਚ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਇਨ੍ਹਾਂ ਵਿਅਕਤੀਆਂ ਨੇ ਲੋਕਾਂ ਦੇ ਭਾਵਨਾਤਮਕ ਜਜ਼ਬਾਤਾਂ ਨੂੰ ਭੜਕਾਇਆ ਅਤੇ ਸਮਾਜਿਕ ਸਾਂਝ ਨੂੰ ਤੋੜ ਕੇ ਹਿੰਸਾ ਫੈਲਾਉਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ।
ਇਹ ਦੋਵੇਂ ਮੁਲਜ਼ਮ ਕਾਫੀ ਸਮੇਂ ਤੋਂ ਜੇਲ੍ਹ ਵਿੱਚ ਹਨ ਅਤੇ ਕਈ ਵਾਰ ਹੇਠਲੀਆਂ ਅਦਾਲਤਾਂ ਵਿੱਚ ਜ਼ਮਾਨਤ ਲਈ ਅਰਜ਼ੀਆਂ ਲਗਾ ਚੁੱਕੇ ਹਨ, ਪਰ ਹਰ ਵਾਰ ਉਨ੍ਹਾਂ ਨੂੰ ਨਿਰਾਸ਼ਾ ਹੀ ਹੱਥ ਲੱਗੀ ਹੈ। ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਇਸ ਫੈਸਲੇ ਨੇ ਇੱਕ ਵਾਰ ਫਿਰ ਸਾਬਤ ਕਰ ਦਿੱਤਾ ਹੈ ਕਿ ਕੌਮੀ ਸੁਰੱਖਿਆ ਅਤੇ ਜਨਤਕ ਸ਼ਾਂਤੀ ਨਾਲ ਜੁੜੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਕਾਨੂੰਨ ਬਹੁਤ ਸਖ਼ਤ ਹੈ। ਅਦਾਲਤ ਨੇ ਕਿਹਾ ਕਿ ਟਰਾਇਲ ਕੋਰਟ ਵਿੱਚ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਚੱਲ ਰਹੀ ਹੈ, ਇਸ ਲਈ ਇਸ ਸਮੇਂ ਦਖ਼ਲ ਦੇਣਾ ਸਹੀ ਨਹੀਂ ਹੋਵੇਗਾ। ਇਸ ਫੈਸਲੇ ਤੋਂ ਬਾਅਦ ਇਹ ਸਪੱਸ਼ਟ ਹੈ ਕਿ ਦੋਵਾਂ ਨੂੰ ਫਿਲਹਾਲ ਜੇਲ੍ਹ ਦੀਆਂ ਸਲਾਖਾਂ ਪਿੱਛੇ ਹੀ ਰਹਿਣਾ ਪਵੇਗਾ।
The Supreme Court of the country has delivered a significant verdict regarding the major conspiracy case linked to the 2020 Delhi Riots. The Supreme Court rejected the bail pleas of jailed former JNU student Umar Khalid and Sharjeel Imam. The court clarified that based on the nature of the allegations against them and the evidence presented, it is not appropriate to grant bail at this stage.
Serious allegations were leveled against Umar Khalid and Sharjeel Imam for inciting violence and hatching an anti-national conspiracy during the Delhi Riots. The Delhi Police has registered a case against them under the stringent provisions of the Unlawful Activities (Prevention) Act, known as UAPA. Investigative agencies argued in court that these individuals provoked emotional sentiments and attempted to spread violence by breaking social bonding and harmony.
Both accused have been in prison for a long time and have applied for bail several times in lower courts, but they have faced disappointment every time. This decision by the Supreme Court has once again proven that the law is very strict regarding matters of national security and public peace. The court stated that since the trial is ongoing in the lower court, it would not be right to intervene at this time. Following this verdict, it is clear that both will have to remain behind bars for now.
